I didn't say that I wasn't going to provide documents, only that I will upload them to an online repo that I am in control of, and that I would share links to these. You shall still be able to read and download them no different from if they were hosted here. And, the issue I have is not so much with hosting, but using an online pdf editor to create a multi-page pdf, again I have discussed this that same message.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have recieved the initial fine through the post, complete with a picture of the back of my car, which i thought was a bit strange due to the dispute being about displaying a valid permit, which if i had one would have been in the windscreen.

i have found some template letters on this site, should i send them one of these or just ignore all letters from them and pretend it didn't happen. i dont want to worry myself about this.

it is not a FINE. do they call it a fine ? I always advocate ignoring the PPC completely. If you write they will smell your nerves (and money) and pester you all the more. read around here, be comforted.

 

No they dont call it a fine. i will ignore this letter and keep this site informed of my progress.

Yesterday i recieved a letter from Rossendale Collectors and they are requesting £115.00 by the 20th. I recieved the letter on the 20th but it was dated 16th which is a bit strange. It doesnt take the royal mail 4 days to post a letter. One of there stupid scams.

 

I rang the number to state my case and the woman says i was arguing with her and she didnt even give me a warning and she cut off. That is totally unproffesional because within a call centre 3 warnings have to be given before you can cut a customer off and they have to be abusive. I know this because i work in a call centre..

 

One other thing, they cant give me a CCJ or ruin my credit history unless they take me to court and i lose, am i correct??

No not really, it was barely an offence compared to what other motorists had done. The person who issued tickets did not do his job properly by giving everyone a ticket but just me. I have enough evidence to prove my case.

No - they can't do anything except try to scare you. As for what a call centre does, it is hardly relevant here - this is just an office designed to tell callers that there's nothing that can be done and no appeal, just pay up. Some people believe them and do just that.

 

The rest of us know better.

Thats what i thought, this guy just joined today to try and hustle us out of money. Cant you guys do something better with your lives, like go on holiday or something... oh i forgot you need ppl like us to pay for you, yeah whatever......:lol:

Easy now folks. Honest Brian is one of my finest crack troll troops. a veritable ninja of the keyboard with lightening wit. Granted he is having a bit of a bad day just now and looks a bit of a dork but believe me when he is on top form his clinical and astute reasoning knows no bounds. With one stroke of the tongue he is able to convince all around that PPCs are not thieving scumbags but knights of old performing a valid and worthwhile service. You have been warned and will no doubt soon fall under his silken spell.

Just ignore those clowns, don't pander to their ego by engaging them. Treat them as you would any other shyster trying to con you out of money.....

Personally I would ignore them, nothing will happen. Whatever you do NEVER admit you were the driver. You maybe the registered keeper but you are not in anyway legally obliged to tell them who was.

 

These companys are just after money, please don't fund them, Letters talking about baliffs and court action, debt collecters it's all a load of @~IT. Before any of that they would have to take you to court, and without them knowing who the actual driver was, they can't prove anything.

 

Best course of action is to do nothing, let them waste there time, on there silly scams.

1. You shouldn't really have contacted them. No harm done, but as you've discovered you can't reason with these people. The woman on the phone is obviously an idiot - it's hard enough to get their victims to call in the first place, but if she then cuts them off she's an nitwit.

 

You need to get your head around the [problem] nature of the whole thing.

 

• do not pay

• do not contact them

ignore any letters or phonecalls

• they will give up and go away

• they will not take you to court

• you're right about how you get a CCJ, but you won't even be going to court so don't worry

 

Rossendales are well known. They are a bottom feeder company who you should ignore and definitely not bother communicating with.

So far I have ignored the demands for payment, and true to what has been posted today I received a demand from Rossendales. Now I know you all say take no notice, they will go away. Will they really? I find all this scary. I have honestly done nothing wrong but I need some assurance from you guys.

If you pay them, they'll go away. At the same time, if you email me your address I'll also send you a few threatening letters and you can pay me too if you like. Silly, isn't it? Give yourself a shake and move on.
