    • ignore them all totally a DCA is not a BAILIFF on ANY debt and have ZERO legal powers  stop blindly ringing people!! if you've paid sums after you cancelled, regardless to if they registered it or not, go do a chargeback and get the money BACK!! dx

    • the ref number should be on the label in their code. i seriously doubt £290 is interest on the sum the trainers cost to date...unless you used one of their buy now pay latter schemes whereby the interest can be 60% if the sum is not paid in the 1st 12mts. dx    
    • As far as I'm aware it's just the interest from the trainers. They have since emailed to say they have put my account on breathing space for 30 days so I can come up with a payment plan. No way that's happening. The email was from Frasers group financial services. I have to get in touch with studio regarding the missing trainers. I have emailed them. But it's going to be difficult, I think, I don't have the original order reference number. All I have is the tracking information and a returns label that was inside the packet with the trainers.    
    • it can be done online the very same day, stop panicking. make sure you read through my post CAREFULLY, compare ref numbers etc, so you know EXACTLY what to ask/tell DVLA has happened. once they find you payments and attribute them to the correct VEL account the matter should be resolved and the SJPN summons cancelled, though the DVLA phone OP might not know/have the authority to deal with that. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good evening everybody!

Well here goes, have been passing letters back and forth as per guidelines re: £750 charges on my BUSINESS account. Last phone call with the customer relations manager, she said that although I may have heard of people getting their money returned, as a business account customer I do not come under the Unfair Terms of Consumer Contracts. This has been backed up with a letter. What I want to ask is....... can anyone explain to me how The Unfair Contracts Terms Act 1977 is different and how does it differ from the other one?

Anyway, I have ignored them and started my action at Bodmin County court.

I have already won 1 claim against BOS and that was a Business Account. The terms I used were 'the Unfair Terms in Consumer Regulations(1999) and the Unfair Contract Term Act(1977)' I have just started a Summary Cause action against them using the same terms. Due in court in March, I'll let you know how I get on. There is a template in the Bank Templates Library for Business Accounts.Have a look in the BOS Forum and start a thread to let us know how your getting on.

Soloman 15.Best of luck with your tassel against B.O.S. I have a sumary case going for a business account for Unfortunately £ 1500. as this is the max. in Scotland. I did talk to a couplkt of lawyers (both female) who did not lead me to beleive they would be any good so decided to go the Sumary case by myself. Without going into a long story about the bank losing the case papers and getting a couple of weeks continuance. Anyway they decided to settle but unfortunately I wanted travelling expenses and loss of income etc. Which now I hear I am not entitled to receive. But any way they are prepared to pay me the whole amount on the original papers. I am still trying for more but we will see. I have just had a small claim against their credit card div. which they have not defended so all going well I shoukld win by default. Best of luck and don't be put off by the rumbings of people who do not know what is what.
