i got a letter today URGENT FINAL DEMAND from DML acting on behalf of Aktiv KApital demanding £117.18. So i called them the information they hold looks as if it's me but the debt is from a loan which i cannot remember from the early 90's. i have had no corrispondence from them or anyone else and as far as i'm concerned i cleared all my bill when i moved from that address. during the call today i said i did not recall the loan and asked for proof before i gave someone that sort of money.

 

Am i correct in thinking that it's now barred because it's over 6 years old and what should i do now?

 

Any help will be greatly appreciated. thanks:-?

If you are sure that its over six years old and you have had no correspondence or made contact with anyone regarding this debt, then the debt is indeed statute barred. The DCA will know this but are probably just trying their luck.

 

Check your credit files and make sure that the DCA hasn't placed a default on your file.

 

You can either ignore them, or you can use the 'Statute barred debts' template in the stickies.
