Hi,

 

Sorry to be a pain but I'm just researching the threads in this section, (usually only browse in BAG) and was just wondering what a CCA and an S10 is ?

 

I had a baliff call round my house (Robinson Way) [edit a dca doorstepper is NOT A BAILIFF!!] last week and frightened to death I paid the £113 debt. So no money to live on this week .....

 

Anyway I've got another account with RW and just need to sort out my next step as I cant afford this one straight away (£319 powergen)

Hi Welcome to the site.

 

The CCA is the consumer credit act.

This is the 1974 act with ammendments in which credit agreements are regulated and enforced,and of course forms the statute.

 

You will see here people referring to applying for a cca,

this generally means writing for copies of original agreements to creditors and collection agencies, that are covered by law under the act.

 

In the case of s10 this refers to section 10 of the data protection act,and is often used to stop or request a halt to contiunued processing of personal data.

 

In the case of your dealings with RW if you are happy with the amount of the debt and also the formation of it,then you should seek advice here.

 

 

There are guidelines on collection and especially where it can be considered financial hardship.

 

Much will depend on the circumstances.

 

If on the otherhand you are in dispute with part or all of the debt,

 

 

Then you should consider making a formal cmplaint to Energywatch who are the regulators and take complaints quite seriously.

You can do this online via their website.

 

You are then entitled to inform RW that you are in dialogue with EW and that they should suspend collections until there is an outcome.

 

However you should only do this if there are questionable reasons.

 

 

Have you exhausted all lines of contact with Powergen to deal with this ?

 

We could do with more info,and also on the money you paid previously.

 

What documents were you given,

 

 

how was collection made where the debt originated from and so on.
