      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

That's good news mate!!!

 

I was reading Martin's Moneytips today and he and the guys on here are getting together to help the "20 claimants from Hull" where the judge has ******* stopped the claims.:p

 

Maybe yours would prove as "high profile" a case for their involvement (personally I think it would probably do more good to our cause) to prove what liars banks are!!

 

Let's hope the powers that be pick up on your case and help you take it to a positive - for you - conclusion!!;):D

HI Atlantic,

Well I have been constantly harassing the RBOS to produce statements to show these transactions that I have posted about have taken place...........today at 5:15pm in return to a call I made to Mr John Kennedy at CMS ( who was not at his desk again ) this call was from a Mrs Sergeant, who has now told me that Mr Kennedy has obtained some statements on this account ( Didnt tell me how many, or when from or to) but said it was a slow process as he has to order them on a month by month basis....as it was a "closed " account

What that exactly means I'm not sure, I dont think it means he can only order them 1 a month as he only started to get them last week.

What this means is the Bank again has stated to the Information Commissioners Office,.. me,.. the Court that " they only keep records for a period of six years in line with the Banks policy of keeping documents" LIARS and I have got that in Black and white in a signed statement of truth.

making them from their internal records?

that is seriously smart sparkie - getting an MP involved........

 

they can pull serious weight in the House of Commons.........

 

we've had a couple of MP's from Cornwall (where i'm originally from - hence my sign on name "atlantic")....and they've got heavily involved in bank charges - one even pulled off a minor debate......

 

you might even be able to get him to get you a barrister or some publicity over your case........ banks really don't like negative PR - which could be a super idea for you, but you'd have to get in touch with BBC or a journalist..... which again shouldn't be so hard as there's a couple looking for stories in the front of CAG....

i gotta admit your last post about having got the MP involved really opened my eyes a bit - really smart move.....

 

i know the MP's back home (Andrew George and Matthew Tylor) are pretty vocal about the bank charges stuff and (I think) both have tried to get some sort of debate going....... but it was more a publicity stunt to tell people that it is possible to get charges back....

 

i know it's just my humble opinion ...... but still say you need heavy duty legal help - they do have a barrister after you.....:)

Ok...I ask because i know MBNA did a search without my knowledge, they put their foot in it by telling me to the penny how much was outstanding on my mortgage, car etc. I cannot see the 'footprint' on my file yet there is no way i could of given them that information off the top of my head.

 

Will be watching with great interest.
