Hi

On 23rd Oct I sent for the data info from Lloyds. They replied on 28th Nov.

 

What an eye opener working out what charges I have paid over the 6 years..£2226 !!

 

Then sent letter requesting repayment of these charges on 3rd Dec giving them 14 days.

 

Received a refusal letter on 16th Dec.

 

Sent the LBA letter on 16th...they'd have received it on Monday 18th Dec.

 

Received a letter from Lloyds on Thursday 21st Dec full of the usual stuff about its their business right to charge......and offering £750...saying it will be credited to my account within a couple of days.

 

Immediately replied insisting that they pay the whole amount. That letter was received on the 22nd.......then it is the hols!!!

 

Went to cashpoint on Saturday morning to discover that the 750 had been put into my account.

 

So my next step is to proceed with the small claims stuff to try and get back the remaining £1456

 

I used the template letters from the library for all my communications with the bank. Thanks for that. Will make a donation - it has been worth it so far.

Hi Jayne.

 

I suggest that you leave the £750 untouched until the claim is settled, then they cannot claim that you had accepted it as a full and final offer.

 

You could drop them a line saying thank you for their offer which you are pleased to accept as part settlement and that you will be pursuing the balance through the county court.

I can see your point but tend to disagree, as if they have not put in full and final settlement I cant see how they can claim that I was. I have had 2 final resonses from Lloyds TSB and I expect another one too. I did however wait until the money had cleared in my account to write to them stateing that this was accepted as a partial settlement only and that I would continue with my claim (which has also been suspended currently due to a silly mistake which I have made) for the remaining balance (which I am having to refile for due to my error).

 

Sound advice though but I have dipped into mine what with christmas and all.
