    • I have a debt that went SB in 2020, Capquest are still occasionally writing begging letters, i just chuck em in the recycling.
    • My Ebay account was permanently suspended for "buying activity" allegation. I literally have no idea what they are talking about.   It's literally impossible to contact them by email or phone if your account has been suspended. They owe me: 1. £400 for items sold which have been delievered to the buyer 2. £350 for a faulty computer screen I purchased , which I now can't return. It's unacceptable they should hold my monies under these circumstances.I have video evidence the computer screen is faulty. But its completely frustrating, because you cannot under ANY circumstances contact  them by email or phone if your account has been suspended. So I cannot find out what guidelines I'm supposed to have broken. I'm not prepared to accpet this. I have Ebay's physical address. I am going to go to the small claims court, and appoint bailiffs `if I win and they don't pay up. Do you think Trading Standards would be interested? Or is there an Ombudsman to go to? With literally millions of accounts, this must be happening all the time. Ebay must be retaining millions of pounds under false pretences. Is it not the law you can retrun a faulty item bought over the internet, whether from ebay, or anywhere else?

    • Hi I stupidly left my handbrake off,  and my car rolled down a hill and into a fence owned by a company. I am a part owner of the company that owns the fence. My car insurance (Prima) states they won't cover the damage to the fence, just the car as they state  "you own the land', although I don't and I did make that clear to them when reporting the accident.. I understood a company is a separate legal entity, so should be considered third party damage and car insurance should cover? The property has a £400 excess and I'm already going to be paying out the £500 excess on car insurance, so want to avoid paying both if I can.. Thanks for any advice you can give...

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Drop that fee paying DMP!

You're not paying off your debts, you're lining DFH's pockets. I've looked in their terms and conditions and 23.5% of your payments are going to DFH and NOT your creditors!

A DMP is really easy to handle yourself. Nothing more than a few stamps to your creditors with a pro-rata offer.

List your debts here. Including current owners. We can look to tackle this further.

I am have an arrangement with most of my creditors, they all agreed to freeze interest at the time the DMP started with the loan exception on My Community Bank.

I was with DMC until January just gone, since then I have been taking care of it myself and until recently My Community  Bank were the only one not playing ball.

Here is a list of the creditors and what the current balance owed to them is, at the current rate I am paying I should be debt free between 18 and 21 months.

What was the original credit based on that's now owned by link?

You better not be blindly paying a DCA like a cash cow.

Original creditor for Link was Aqua, the original debt was for £6k, prior to the debt being passed on to Link it was reduced to £3k following a claim for irresponsible lending.

just keep doing what you are 

good work, though id not be bothering with the stupid cease and desist letters, very old hat and just pointless letter tennis. block phone numbers, email addresses and reports txts to 7726 if it annoys you.

as for those that wont accept freezing interest and charges, write to them telling them they are not helping you as they are legally mandated to do, and drop their payment to £1 PCM till you die.

nothing they can do.

please try and keep to this thread eh?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I have now got a creditor who will not accept an income/expense form, they want access to my account using open banking which I do not want them to do.

Can they refuse an income/expense form as this is the usual way to communicate your finances with them.

The creditor is salad money.
