Good afternoon. I too have recently received letters from both Hoist and Lowell, and I am informed by Lowell that their letter refers to 'your former agreement with Barclaycard', and that the balance due under that agreement has been assigned to them. I also see an (unopened) email from Lowell is sitting in my Inbox.

 

Between 2010-2012 I had a number of debts, all of which I maintained as best I could, offering minimal payments etc, although the majority were written off by 2013. There is no debt to Barclaycard in my (very meticulous) records for that time, and in fact I do not recall even having a Barclaycard, although my memory isn't that great, and I may well have had one prior to 2010 but honestly can't remember.

 

Clearly the timeframe for all this is beyond 6 years, but despite that, I am concerned that there may be a 'live' CCJ that was raised at that time and which never came to my attention - could that have happened? I have moved twice since that time and there is nothing on my credit report to indicate that a CCJ was ever issued. Is there a way to find out if there is anything out there in my name?

 

So, in summary, before I think about sending Lowell the SB letter, should I attempt to find out if a CCJ was ever started, or, if I'm not sure I even recognise the debt (I have quite a common name so could they be phishing, and it's a coincidence that I too had debt at that time?), should I send a Prove It letter instead? Also, do I open the email or leave it (as I'm guessing they can tell once it's been opened).

 

I'd be grateful for any advice, especially as my Dad has just died, so this worry on top of everything else is just awful atm. Thanks in advance.

Thanks, but would I have to guess via which address a CCJ may have been issued, when inputting my personal details? (Or would it somehow link to current address?).

CCJs are registered against people not property

But if you have a common name, wouldn't you need a correctly linked address to provide a definitive CCJ answer? And as I have several addresses over a 10+ years period, I'm unsure how to complete the Trust search in respect of the address...

All my previous addresses show up in my credit report profile (but not sure what you mean by linked to you).

 

Haven't yet tried Trust with my current name and address (was awaiting advice re which address to use).

Use your current address, be proactive.

 

They will let you know if they need any further identification.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

if all old addresses are showing on your file but no CCJ is

then thats strange if a CCJ DOES actually exist and was within 6yrs.

Do I need to carry out the Trust search before sending the SB letter?

Could 'Trust' attempt to make me pay £6 for each different address?

 

I'm still worried that if I SB dca, they could still turn around and say a CCJ was issued in 'x' year, and therefore the debt is not SB...

 

Could that realistically have happened without my knowledge in the past 10 years and not be showing on my credit report?

CCJ like defaults only show for 6yrs.

Well you have to do something surely?

 

Make a decision, either check Trust online, or send them the SB letter, alternatively you can always do nothing and be none the wiser.

 

Trust online will not charge you per address, it doesn't go against the address, CCJ's go against the name, otherwise all you'd have to do is move house.
