Hi all.

I have been reading through to get some advice on this bunch of nasties.

For the last few weeks, my mother who is knocking on 70 has been receiving phone calls from Mackenzie Hall asking for me. Luckily, she still has her marbles and said to them that I dont live there(which I dont and never have!!) The phone calls were apparantly quite aggressive in tone but she has told them nothing. I called in to mums todays to find a letter from Mackenzie Hall (A final notice), addressed to me, asking me to pay £2300 on behalf of their client or !!. Now, I havent got a clue what this is all about, my credit record is clear and although I am curious after reading similar posts, I dont really want to contact them as it appears that this may reinstate the debt. My only blemish on my credit history was when I split up with my ex wife in 1997 and I think that I never continued paying for a 3 piece suite on a buy now, pay later scheme. That was in 1997 though and I havent heard a thing since. So perhaps wrongly, I assumed that it had been written off. What should I do, ignore them, contact them, offer payment. Suggestions and advice would be greatly appreciated as it is quite upsetting to my mother to be hassled with phone calls about something that is nothing to do with her. Thanks.

Might be an idea to look at your credit file and see if there is anything outstanding. A ccj may have been applied on your account in 2002 for

example, so would still be current at the moment. MH do seem to

specialise in trying to collect debts that are almost out of date.

 

The next time MH call, your mother should ask them not to call again as you don't live there. If they call again, you will already have bought her an

ear piercing whistle that she can use to make them change their mind.

well if you have not acknowledged the debt in writing or made a payment for 6 years it will be statute barred under the Limitation Act 1980.

Hi, I'm not sure whether I am writing in the correct post or not so apologies if not, I'm still trying really hard to navigate 'round this site!

Basically, my OH and I had a debt with LLoyds bank which was a culmination of overdrafts and loans (I think). They were taking money out of our current account to pay for a loan with them when we didn't have an overdraft facility, but they did this until the debt reached about £18,000.

We stupidly at the time never defended ourselves when they took us to court and consequently got a ccj for the full amount.

The debt was then taken over by Sechiari Clark and Mitchell several years ago and we've been paying them £125 a month since.

We came into a small sum of money a couple of years ago and asked them for a settlement of say £8,000 but they said they wanted no less than £14,000 (which we didn't have).

I think what I'm asking really is is there any way we can either get out of this or reduce it in some way? We really can't work out how they have made the debt so big and what it really exists of.

My credit record was clear of my MH debt but I was only searching on my current address when I applied for a copy of the credit report. You should re-request your credit report and give them your last 3 addresses (in particular the address where you had the sofa) you may find, like I did that you have a default registered against you at an old address which is still linked to your overall record.

 

I would also ignore MH, they will go away when they get bored.

You need to write to the morons handlingyour account and ask for an up-to-date statement showing payments made against the total. It should not have interest accruing.

 

This also sounds like a cas ewhere you could claim illegal charges back from Lloyds. How old is this matter?

I don't think it has interest accruing as such, I just think the whole thing is unlawful! It is over the 6 year threshold I think so I don't know where I would stand.

Would I need to contact Lloyds or Sechiari?
