Hi

i really need some advice here please,

 

i have a debt relief order in place which was granted in January,

whilst all my other creditors have abided by it Vodafone have not, they keep asking me for payment.

 

I have been back and forth with their complaints department who have said their insolvency services are saying the debt relief order for Vodafone isn't valid as i have a active line.

 

I explained to them that they can not continue to chase me for money and the lines should therefore be cancelled but they will not listen to me,

 

now they have asked me to removed vodafone from my list of creditors.

i question your wisdom of a dro in the 1st place esp for what i bet will turn out to be all historic consumer debts?

voda dont have to agree no 

and you cant demand they stop chasing you either

 

why not simply ignore them then and cancel their contracts?

original creditors dont do court anyway....

the dro includes the vodafone account and you are correct it is for some historical debts and some 2 year old debts

i have issues due to mental health in understanding money 

 

had JD Williams accounts too

as well as a aqua credit card

the debts were £9600 in total,

 

i spoke to stepchange who suggested the dro was the best way forward as it protects me against the ccjs that were on my credit file too and after 12 months all debts on the dro are written off.

 

I personally never put vodafone on the list of debts but upon checking my credit file stepchange added it, i asked them what was best way forward as at the time my account was still live with Vodafone and was told once the dro is issued the account should go into a default state and the line disconnected, the dro info does state companies can not chase me for money once the dro is in place.

 

Aqua, JD Williams and Lowell have all abided by the rules it is Vodafone who are constantly chasing me.

 

Your idea about just ignoring them seems the right way as i don't think any debt collection agency will touch the debt anyway due to the dro,

 

Vodafone are really stressing me out though, i have depression and anxiety and they are aware of this.

 

It is Vodafones insolvency department that is causing the confusion as they keep saying i have a active line so they can't abide by the dro, yet the actual insolvency service are saying Vodafone must abide by it and can not ask me to make any payments.

 

I wish i knew about this forum before i took the dro tbh.

 

I only found out about it as my mental health worker told me about it today.

so you have existing County Court Judgements...Who from about what please?

wont be any original creditors but debts sold to DCA's?

 

you do realise any DCa ARE NOT BAILIFFS

and have ZERO LEGAL POWERS with or without a CCJ?

 

the DRO does not protect you against further enforcement of any existing CCJ.!! nor remove them early

but as they are consumer debt related and you are not a home owner there is stuff all anyone can do anyway.

 

seems like you've been had blind for years and are only just waking up!!

 

how far are you into the DRO?

Think you hit the nail on the head tbh maybe that dro was the wake up call i needed.

 

I'm 2 months into the dro now got 10 months left,

i did have a bailiff visit last year for a old o2 debt

i didn't answer the door and he was told to leave the block by a neighbour and he left.


ccjs are for

vanquis,

o2,

there was a isupply one but after 3 years of challenging it it got deemed as settled.

bet it wasn't a bailiff, but a powerless debt collector , 

a BAILIFF can ONLY be granted by a JUDGE after a CCJ has been gained AND after the CLAIMANT returns to court to rEQUEST one be used ( and even THEN they are POWERLESS on consumer debts)

pers i'd leave things as they are and simply ignore the scary letters.

 

ideally what you should have done is DEFEND any claimforms you get ...NOT IGNORE!!

Bailiffs have no power of forced entry or anything on a consumer credit CCJ.

 

we call them busted and stupid.

 

was probably a for a CTAX LO not a civil debt CCJ.
