    • Northmonk forget what I said about your Notice to Hirer being the best I have seen . Though it  still may be  it is not good enough to comply with PoFA. Before looking at the NTH, we can look at the original Notice to Keeper. That is not compliant. First the period of parking as sated on their PCN is not actually the period of parking but a misstatement  since it is only the arrival and departure times of your vehicle. The parking period  is exactly that -ie the time youwere actually parked in a parking spot.  If you have to drive around to find a place to park the act of driving means that you couldn't have been parked at the same time. Likewise when you left the parking place and drove to the exit that could not be describes as parking either. So the first fail is  failing to specify the parking period. Section9 [2][a] In S9[2][f] the Act states  (ii)the creditor does not know both the name of the driver and a current address for service for the driver, the creditor will (if all the applicable conditions under this Schedule are met) have the right to recover from the keeper so much of that amount as remains unpaid; Your PCN fails to mention the words in parentheses despite Section 9 [2]starting by saying "The notice must—..." As the Notice to Keeper fails to comply with the Act,  it follows that the Notice to Hirer cannot be pursued as they couldn't get the NTH compliant. Even if the the NTH was adjudged  as not  being affected by the non compliance of the NTK, the Notice to Hirer is itself not compliant with the Act. Once again the PCN fails to get the parking period correct. That alone is enough to have the claim dismissed as the PCN fails to comply with PoFA. Second S14 [5] states " (5)The notice to Hirer must— (a)inform the hirer that by virtue of this paragraph any unpaid parking charges (being parking charges specified in the notice to keeper) may be recovered from the hirer; ON their NTH , NPE claim "The driver of the above vehicle is liable ........" when the driver is not liable at all, only the hirer is liable. The driver and the hirer may be different people, but with a NTH, only the hirer is liable so to demand the driver pay the charge  fails to comply with PoFA and so the NPE claim must fail. I seem to remember that you have confirmed you received a copy of the original PCN sent to  the Hire company plus copies of the contract you have with the Hire company and the agreement that you are responsible for breaches of the Law etc. If not then you can add those fails too.

    • I understand what you mean. But consider that part of the problem, and the frustration of those trying to help, is the way that questions are asked without context and without straight facts. A lot of effort was wasted discussing as a consumer issue before it was mentioned that the property was BTL. I don't think we have your history with this property. Were you the freehold owner prior to this split? Did you buy the leasehold of one half? From a family member? How was that funded (earlier loan?). How long ago was it split? Have either of the leasehold halves changed hands since? I'm wondering if the split and the leashold/freehold arrangements were set up in a way that was OK when everyone was everyone was connected. But a way that makes the leasehold virtually unsaleable to an unrelated party.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

have done all you suggested,  it will not copy anything,  or do anything :/, no idea what doing wrong,   can not even remember what new comp has GB/MB/ etc, not even sure  will like  it as been so sued to using this, windows 8.8.1 and chrome for OS

one drive saying need to update windows, did that but says no new updates, so for now I can not put anything onto one drive, I give up

Create a 'backup' directory on your empty d drive called backup

Download the 64 bit portable version linked above into the new backup folder in your empty d drive

Its a zip file - just Extract it (right click - extract)

Go into the extracted folder

run Persbackup.exe (if it cant access folders etc - right click on it the next try and 'run as administrator)

 

It might look a bit complicated - thats mainly because you aren't familiar with it

 

Start wizard

chose backup to local and select d:\backup as the backup directory

[next]

tick documents, music, Pictures video, downloads

- and click the green arrow to add them to backup list

[next[

then just ensure separate files, separate directories, and save without compression  is selected

[next]

Start this automatically - no

Click on done and a save for the task will come up - call it 'one' and save it into the d:\backup folder

 

it will run a quick calc and then show the bigger screen with the taxk - and looking at it you will see the size and may be required to select which sub folders from the directories you want

- tick any you think you want

Just a question reference onedrive issue?

 

Have you ensured that all your Drivers are completely up to date by doing a manual search in windows 8.1 and also ensured that you have the latest windows updates again by doing a manual search in windows 8.1

 

The only reason I ask the above is the onedrive with Windows 8.1 can be a fussy bugger if something as simple a one driver isn't up to date or a windows update isn't up to date in that specific version with trying to use onedrive.

hi Stu,

I have tried that but I think my comp has given up, I clicked the updates and it  said restart comp which I did but it still not let me do any updates, I have even typed in driver updates... nothing.

 

TJ I will give your suggestion a try if get time, new comp arriving today but still need transfer everything on this one to new one 😕

am convinced  it is my comp as when I  go to open a page all I get is the bar across the top, I then have to click onto the maxamise bit to open it

That seems to be browser screen defaulting to that bar 'size; when opened. resize the window by click and drag from a corner.

 

The program linked above does some of the 'sorting out and copy paste for you and doesn't need installing with all the extra probs that installing a program and missing dll's might cause on a 'confused' win 8 install

 

There are ways to rebuild the drivers which I could link, but it involves a couple command lines, so a last result.

 

Mainly prioritising getting your pics available to check and make available away from the windows system at present - which that should do

Problem with full blown paid transfer programs is they are as likely to have probs with a dodgy win8 system as anything else.

Then get your browser site user names and passwords if necessary

well new comp has just come, not unpacked it yet, am sure  said was windows 11 but says windows 10, will   see what other info it says, it is an all in one

I have not set up the new computer yet, been too ill today, I did try a memory card I had but it did not open and am sure I put items on it when did it before, I just want an easy way to migrate from one computer to another 😕  and not loos anything, got fibre  BB now, not even taken new one out box, feel a failure

problem is, onedrive should be the easy way - but it often isnt for many reasons - Not your fault @sd

 

Have you downloaded and tried the utility prog described ? (to get your pics etc to where they can be better checked and accessed) @ post 53

what happened or didn't with the freeware prog i linked?

I sorted it from a number of options I tested, and checked it before linking it here and it worked fine.

 

You should have ended up with a fair bit of your stuff, including your pics easily accessible on the d drive ready to copy anywhere.

 Thank you for being patient with me, I have had no luck with  anything I have tried, maybe  I am not doing something right?

I d/l the freeware prog but  it did not show how to get everything  from  comp on now to new one, I am now also trying to decide whether I want new new one but can not get it back in the box 😕

I took it it out to look at it, my stupid fault

I just do not know what do now, I am not feeling great at times .

It wont transfer to the new one, just copy all your pics etc out of the windows 8 system into the folder on d so you can access them, find out how big the stuff you want is, and enable copy which didn't work from original location.

Just follow the instructions and we are a good step forward.

hi TJ, That prog did not have anything on it for me to transfer anything, seems no matter what try   either my comp does not want to know or it is me being thick, I followed instructions but it did not really have any, think need a new comp as like said this one  only showing 3/4 screen and it does not open pages right

You can configure and store as many backup tasks as you wish. The selection of the files to be backed up is made on a by-folder basis. All subfolders are included automatically. But the user can exclude or include any subdirectories from or in the backup by selection or a filter. Additional criteria are the selection by file type, file age, and file name filter.

The original drives (C, D, etc.) appear as subdirectories LwC, LwD, etc. The original directory structure remains unchanged beneath these folders. All files may be compressed in gzip, either in toto or separated by subfolders as zip files. Optionally all data can be AES algorithm-encrypted.

I really now need get new comp up and running but can not until have transfer  everything from old one and as it it playing up then am stuck, thank you  so much TJ for all your help, think I am a lost cause 😕 lol

Easiest way to copy all your personal data and transfer to a new computer is to plug in your memory stick or external hard drive.

 

Open windows explorer (file Explorer) click drive C click users (your name/user will appear right click copy that name) will take a while and then go back to windows explorer and click on your memory sick or external drive right click and paste...that will transfer all your personal data Docs/ Photo/  Video/ Favorites/Music etc.

 

Plug in your memory stick/ external drive to new computer open explorer find the external stick drive open the drive then copy and paste each folder to the correct folders on your new PC.

Thats the sort of thing I was woking toward @Andyorchbut SD couldn't get copy to work (which isd a recurring issue with win8 and corrupted system files)

 

The freeware program should bypass that problem and copy the stuff for her

 

She just needs to run it as detailed. It does work and doesn't add anything to the win8 system.

Just follow the suggestion please. If it fails, give us some detail of what you saw, and try again.

 

 

 

We may need to run it in safe mode. But theres no point keep changing tack if you aren't telling us what is actually happening - we are left just guessing.

I do not have windows explorer , I use chrome, always have, TJ I will have another go but atm my computer keeps crashing and making an awful noise

You aren't describing anything @SD?

Just saying it doesn't do anything -  gives us nothing to work with

 

Cant help you with just 'it doesn't do anything'

I know it does - and its independent of the win8 copy issues I've seen reported.

 

You run it - it will do something even if its just report an error

AND it should be completely  independent of any win8 copy sytem issues.
