I didn't say that I wasn't going to provide documents, only that I will upload them to an online repo that I am in control of, and that I would share links to these. You shall still be able to read and download them no different from if they were hosted here. And, the issue I have is not so much with hosting, but using an online pdf editor to create a multi-page pdf, again I have discussed this that same message.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Even the suggestion of any sort of deal which isnt 'we do what we like' will thoroughly p**s off the ERG

Rather strange given how they have utterly rolled over in surrender and offered their bellies like a abused and frightened dog over the Aus and India deals

Crumbling: Hospitals, Schools, council services, businesses and roads

UK to rejoin EU by 2030 ?

Ask 100 Leave voters what Brexit meant to them and they will have different answers.

But what is for certain, is that most asked this question, will say that they did not vote Leave to damage the UK economy.

The move towards a Swiss/EU form of relationship will be the first step in a series of steps that moves the UK towards rejoining a reformed EU.

UK needs to have frictionless trading with EU and there needs to be arrangements to allow easier movement of migrant workers, to help fill vacancies employers have.

Heres a thought

The situation is so bad at the moment, that even a very limited EU deal will improve the utterly dire situation quite disproportionately and will 'appear' far better than it is ..

Is that what Sunak is aiming for/trying to squeeze past the ERG?

on a related note, if the export situation is so dire for UK cattle and sheep farmers, why has the meat become so extraordinarily expensive? and thats just the cheaper cuts?

Well, being as they haven't delivered the:

* No one is threatening our place in the single market

* All the benefits, none of the costs

* No roaming charges

* or even lower immigration - just lower migrant workers

It seems well beyond time for Rees-Moggs 'second referendum once we know', let alone a money back refund from the Tories for their 'not as described' Brexhit

One issue that must be concerning is the big increase in the costs of labour rates and materials. I have just had my Home Insurance renewal through and the premium has increased by 20%. This is because Insurance companies are having to pay out much more in claims to cover cost of materials needed to repair damage and for contractors pay rates. And the Insurers have increased the excesses for escape of water claims, presumably on the basis that more homeowners won't have heating on during the Winter.

The same increases in costs will impact on most building works, both domestic and commercial and this is going to feed into increased inflation as these costs are going to be passed on. So this will mean increased loans/mortgages and repayments due. Increased costs of goods in shops, as businesses will have to cover their costs.

This is not all down to Covid affecting production and shipping of materials and goods. Some of this will be down to Brexit, as the UK as an island nation is importing most of what is required. Therefore, if there is an increase in trading costs, the price of goods will increase. And if the supply of labour is reduced, wage rates increase and the costs of any contract works is increased.

Are Government and OBR being optimistic with their inflation forecasts ? Could the increase in costs continue to fuel inflation and it remains close to 10% for longer ?

Whoever the Angela is you are referring (even if its larry graysons ghost) it seems likely the referred chest would have more actual valid honest content  than the content of your conspiracy posts

So, rather than misdirecting, lets focus on the undelivered, not as described claims of the Brexhiters, which undelivered features and benefits was what the British people actually voted for -

* No one is threatening our place in the single market

* All the benefits, none of the costs

* No roaming charges

* lower immigration - NOT just lower migrant workers

and having failed delivery on the promised features and benefits, surely its well beyond time for Rees-Moggs 'second referendum once we know', let alone a money back refund from the Tories for their 'not as described' Brexhit

... From whoever is in government, Starmer, Nandy, Raynor or whoever the latest Tory party Temp with ZERO mandate might be.

While we wait for an engaged answer

With the West focuses on the fight back of Ukraine from the Russian invasion, Turkye and Iran are bombing the wests forgotten Kurdish allies in Syria and iraq

With Turk'ye seeming to be expecting to actually invade Syria (now Russia is resource drained) to massacre the Kurds and gain back a bit of its empire

I think theres a chance the Syria issue will be resolved before we get straight answers from Brexiters

The Guardian's newsletter this morning has their Brussels correspondent on why the EU wouldn't consider a Switzerland-style deal for the UK. Cherry picking again.

Says it all:

“You don’t get much reaction from Brussels or national governments to stories like this,” Jennifer said. “They know it’s a test balloon for domestic consumption.”

The Brexhiters are still spinning the cake and eat it versions of this that and the other deals despite any even slim possibility of that also flushed into UK waterways in the first few months, when the EU realised they weren't dealing with the canny, capable British of old, and were dealing with dishonest gob****e fantasists. who couldn't be trusted to honor any deal they agreed anyway.

I think its more a spoiler attack on Sunak by a corrupt (IMO) 'Johnsonite who sees Johnson as his route back to a peerage and lobbying payments, and is happy to attack the tory party to pursue those ends

I think the only doubt is whether

 it is

* ERG + the really extreme right

*Johnson camp

* some mixture of them as they are a hodge podge of self interested parties

that is .. behind him .. driving his self-interest

Six years on from the referendum, we can see clearly there are no economic opportunities from Brexit; nor any social or environmental benefits. Brexit has been a disaster.

just a point on Patersons bull about deporting immigrants ..

Is that all to Rwanda at a £100k+ a shot? as the vast majority of countries wouldn't accept deported migrants from the UK ... as it breaches the convention on human rights and they have no agreements with us.

We could deport EU nationals back to the EU while we were a member - dont think we can do even that anymore unless they agree
