Well it is what it says on the tin ......unregulated......no protection....apart from the FCA which can look into problems.

 

Some interesting points in the following.....I know its with regards to Regulated Mortgages but there a few section about Commercial mortgages...

 

" There may, however, be instances where an existing contract, which was not a regulated mortgage contract at the time it was entered into, is replaced as a result of a variation (whether the variation is initiated by the customer or by the lender), and the new contract qualifies as a regulated mortgage contract. A person may therefore need to consider this possibility (which could affect contracts initially entered into before 31 October 2004 as well as subsequent loans) when deciding whether he needs permission to carry on any of the regulated mortgage activities. "

Hi, the mortgage was taken out on 2005. The mortgage offer had no conditions.  The lender has not kept a copy of any terms (if there were any) and it wasn't signed by the lender. No annual statements so could the mortgage then be considered to co.e under the CCA?. Thanks for your response

Its not regulated by the CCA...thats your problem.Is this still live or now paid off ?
