      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello there, ive already got my money back from hsbc pretty much straight away but im doing this claim for my brother, i went through the usual stages and then ended up filing a claim through Money Claim, received a response just saying that:

 

'an acknowledgement of your claim has been filed today and a copy is attached. The defendant now has 28 days from the date of service of the claim form to file a defence'

 

and on the acknowledgment they have ticked that they will defend all of the claim!

 

Do I need to do anything else at this stage yet or do I still wait? if i wait what shall i expect?

It sounds as though I'm at exactly the same stage as you! I received the same through the post this morning, saying they will defend. One thing - have you sent a copy of the schedule of charges to the court/solicitors to attach to your file? I've read so many posts and some suggest you do and some say you don't need to - I can't decide whether to or not...

Hi Team

 

After you file with MCOL there is a period of 5 days for them to receive the paperwork. It will say issued on MCOL. When it is received by LLoyds solicitors they will mark it as Acknowledged. Then file a defence if they want to go down that route. You will then receive an AQ (Allocation Questionair ) with their defence which you read through and fill in the form. There are guidlines on the site on how to fill this in. You may find a box ticked at this point saying that they want to settle out of court. Contact them to ask for it all back. Lloyds always take it to the last stage then back down. It costs them more in the end. The spreadsheet they do already have i assume,because you need to send that with your Prelim letter. If you do fill in the AQ then add that to the court paperwork as well. You need 3 copies of everything. Hope this helps

This is normal for Lloyds, they take it further than most others, probably in the hope people will drop out. Stick with it though, they always pay up in the end. They will now file a defence within the 28 days, which you will receive a copy of from the court along with an allocation questionnaire. You will have to complete it and send it back to the court and they will pay up sometime after that.

 

You need to have a good look at some of the 'won' threads in the 'Lloyds successes' forum. This will give you a good idea of what to expect at every stage.

 

Also, if you have'nt already, please send 2 copies of your spreadsheet to the Moneyclaim court as soon as possible by recorded delivery. Heres a covering letter;

The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).

I respectfully request that the enclosed schedule should be attached with the particulars of my claim.

You do. If a schedule of charges is not included with your particulars of claim, Lloyds will have grounds to argue that your claim is not adequately particularised. As there is no space for the schedule on the online form, the only way to get it included is to post it.
