Yep.. looks like that is the only route now. Be aware though, there is a possibilty of it going to fast track, which means if you lose you may have the defendants fees to pay. I think this is limited to £750 though.

I will have to check again when i get time tomorrow.

I am debating if I should go for £4999.99 and stay off fast track, but the other hand is I need that money (and it is mine so I should go for all of it)

 

At the moment I am renting out my flat and moving to another town so I do not have time to file the court claim for the next week or so.

 

I am also not sure if I file in Brighton(where my flat is) or file in Camberley (where I am moving to)... Any advice?

I have been reading the threads regarding B & W with great interest.

 

I am about to move after two years and a few months with Bristol & West. Unfortunately I am going to be hit with a £5000 Early Redeption penalty charge. This is our first house as we are living in a 1 bedroom flat at the moment and its driving us both mad with the lack of space.

 

We could really do with the £5000 they are trying to take from us for furniture and its such a lot of money to lose. Is there any way I can avoid paying this money before everything goes so far down the line that I will have to pay and look at trying to get it back at a later stage.?

(Obviously without me getting blacklisted forever more!)

 

I am prepared to claim at a later stage if I have to if necessary but if I can avoid having to pay it in the first place that has obviously got to be better.

 

Please help I am meant to be moving at the end of Jan 07 and all I want to do at the moment is cry at the thought of the amount of money I will be losing.

I think (I maybe wrong) that its has to be paid out initially then claimed back:-| sorry! I got our solicitor to get a letter from them (at the time of changing the mortgage) stating how much the ERC would be so that I wouldn't have to do the Data protection request.

 

I paid it out then started sending the letters a couple of weeks later.

 

UKAviator and Zootscoot know a lot more about this than me, they are far more wise in the world of Law!:D

Thank-you for the advice. I think I will direct my solicitor to this site and have a word with him get things ready as soon as we have paid the rdemtion penalty. I will check out the other threads you suggested though. Thanks again.

My opinion is that Fast Track would cause far more problems for them, than any outside chance of a cost implication to yourself - of course such costs would only be possible if you were to lose, and it would be limited to £500 anyway.

 

It is also worth noting that a claim for £4999.99 would very likely be pushed into Fast Track by the judge at allocation anyway. B&W would also use the argument that you were simply trying to avoid costs, and that the complexity of the case warranted Fast or Multi-Track.

 

Be warned, B&W play hard-ball for as long as they possibly can. They will use any weakness they spot against you, until they eventually are forced into a corner and have to seek a settlement.

 

It does not matter which court you file at - just decide which is the most convenient, and make sure you give your reason on the Allocation Questionnaire.

I sent B&W a letter on 2nd Jan, pretty much the same 'template' as Alison used.

Today I recieved a reply from Mrs Tucker.

Again, pretty much the same response as Alison.

 

What should I do now?

 

Wait til the 14 days are up and then send an LBA? Ill start my own thread and type in the letter (minus the names etc ;) )

 

I appreciate any feedback on my letter(s).

Just came on line for the first time since the move to see what was happening. I was going to file my court claim in the morning but just read jamorgans thread and terrified now....

 

 

DO I still go for it? Are there people on here willing to hold my hand through this if i do??? HELP PLEASE!

If only a quarter of CAG's member contact him thats still 25 thousand people... and taht would really put the fear in the mortgage companies....

This sounds like a good idea Dolly...get a hearing on national TV. Have you done this yet Alison? What about starting a thread encouraging people to do this? If we could get say 20 people, they'd have the potential for a very interesting show.
