• Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

£6bn is nowhere near the £trillions we are in debt.

it matters not where the money has gone. There was a moan about tax increases and a suggestion that the debt be paid back using the Brexit Dividend.

It has to be repaid so if not by tax increases then how ??

That's what you might call it but if it was of any interest others would join in.

You're typical Left Wingers, Instead of just whinging, why not come up with some alternatives for a change

But that is just it, there is never anything constructive about your posts, just whinging and quotes from the Guardian whose owner not only supported the IRA

but actively supported the terror and bombing campains that killed hundreds of innocent people.

Also with all the want, want, want - how about saying where the funds are to come from.

On fishing, talking to Sky News a French fisherman said

"Fisherman Laurent Merlin said: "There is no fish left for us in French waters.

"Sole has completely disappeared already, the small amount that is left is in British waters."

There should be a total block on them.

You can't bait me, I'm far too laid back for someone who has nothing better to do than spend every day and night finding something to whinge about.

On your subject there, what is wrong with someone else paying a bill.  What you are saying is if a friend of yours offered to pay for nursery school you

would refuse.

Scotland should have a right to hold a referendum on independence, if parties supporting independence have a majority in the Scottish Parliament to hold a referendum.

Not sure Scottish people would vote for independence, but they should be allowed a vote.

They had a vote a few years ago.  Just like the calls for a Brexit Ref, you can't keep having votes until you get the result you want.

The problem with Labour is they are not opposing on political points or bringing on things they think will help and appeal to the country,  they are picking on silly things like who paid for Boris wallpaper, that's not opposition.

As this byelection proved, it didn't work.
Too many people seem to take the 'all politicians are liars and crooks so its pointless voting.
Been like that for a long time now and can't really see it going away no matter who is in power.

If you have read that article properly HB you will also have read "people would be able to apply for a voting ID card from their local council".

So not having any is not an excuse.

I haven't mentioned anything about vote fraud, only you have so you show us the proof there has never been any fraudulent votes cast 'ever' ?

Ah, I didn't think you could.

There is voter fraud, you have said so and sorry but you are nothing so your opinion doesn't count for anything.

You just carry on reading the super left-wing Guardian and doing your whinging.

What the hell are you on about now.

Why shouldn't you have ID to go and cast a vote, you can't even get a parcel from the post office without ID, most things require ID so why not to vote?

Also please explain how it will stop people voting,??
