    • god they've got at you haven't they. told you all the usual utter BS. a CCJ vanishes from your credit file on it's 6th B'Day regardless to being paid off or not or paying or not. same with any debt with a registered defaulted date - it vanishes from your file on the DN's 6th B'day regardless. creditfix are Knightsbridge, (they renamed) there are 100's of threads here on Knightsbridge, if i remember rightly 2 of the directors of a certain very big IVA provider were struck off for embezzling £1m's out of debtors. pers i'd stop paying now.  end of . just ignore them all. 99% of your debts are to utterly powerless DCA's and probably were never owed in the first place only goes to firm up my belief from post one..you got had blind. its very easy to deal with the debts even those with CCJ's. can you copy and paste what you credit file says regarding the IVA please?

    • Sorry I meant credit fix - I really wish I'd known this before - kicking myself right now  If they come back to me asking for more money I'll cancel it and start trying to deal with the debt myself let's see what they say  Feeling tempted to cancel it now but scared that some of the debts will do more CCJ's on me and I'll have to wait 6 years again.  2 of the CCJ come of this year and then I'll only have the iva in credit file - effectively if I'd have not took out the iva in 2021 I'd have clear score by now - but then again would I because I would have been hounded the last 3 years, as bad as it is it's saves me lots of headaches whilst my debt was still within the 6 year mark.  I think most of them are near there but in all honesty no point chasing them if I do cancel iva I'd jjst wait for the ones who contact me and then start the relevant letter process on them.  Of over 6 years easy if not still possible to write off. My true victory would be having the iva wiped off my credit file as mis sold or something that way I Don't have to wait till 2027 Other option is to fight back and ask for them to offer the creditors to accept payments so far and use the following method    Will your IVA firm agree to complete your IVA on the basic of funds paid to date? The Guidance lists a lot of factors to be considered in deciding whether a settlement on the basis of funds paid to date should be proposed. You should read the list. But that may not give you any feel for whether they apply to you or not. The following are my thoughts on when an IVA should be treated as settled, not failed. They assume that you have £75 or less to pay a month: if you would currently qualify for a Debt Relief Order, then your IVA should be settled now  There is no point in making your IVA fail and you have to apply for a DRO – it will not generate another penny for your creditors. If you are renting and owe less than £50,000, check the DRO criteria now and talk to National Debtline on 0808 808 4000 about whether you qualify. You may have been told at the start of your IVA that you aren’t eligible – still check now as the DRO criteria have changed, your situation has got worse, and some people were given incorrect information about DROs at the start. if you have no assets that would be realised in bankruptcy (eg a house with equity, car worth over £2000), then your IVA should be settled now Same as (1), there is no point in making you apply for bankruptcy after your IVA fails. if your only asset is a car that is worth less than £8000, then your IVA should be settled now A car that is worth say £5000 would normally be sold in bankruptcy and you would be given a small amount to buy a cheaper car. But your creditors would not get any benefit from this as the Insolvency Service takes the first £8000 raised to cover its own costs. if you have significant assets, the closer you are to the end of the IVA, the less reasonable it is to fail it If you have been paying your IVA for 4 years, you have done your best over a long period. It isn’t your fault you can no longer continue. The fact you may have had equity to release isn’t relevant as that simply isn’t going to be possible. if your situation will clearly improve soon, then it’s unlikely your IVA will be settled I mean real improvements, not hoping that prices fall. If I can get them to accept payment to date or threaten with cancellation hopefully they may accept it -  Other option is to try and borrow money and pay make a full and final offer  Or I can just ignore and hope for the best which I'm very tempted to do especially if they respond to my review with bullying tactics despite me being skint as a fart with no mortgage as renting  It's so stressful but I've just checked the iva agreement from 2021 and it's Cabot 2 accounts Lowell about 5 accounts and then lots of repeats of the same debt with for example zopa and Cabot same amount listed twice -  also loyyds banks but I'm sure that's older than 6 years and not on credit file anyway  If I can somehow remove the iva from my credit file I'd be happy

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What concerns me is that even if he gets what he wants and the Eu signs off on it - he then holds the referendum in June - I understand the MEPs can scupper things but that would be AFTER the referendum!!

 

No way are the trough delving MEPs going to be happy at losing their jobs, which they no doubt would if we were to exit !

Hmm, aren't most of the MEPs failed MPs ?

 

It is also my understanding that David Cameron wants to devolve a lot of responsibility to the Local Authorities and reduce the number of MPs by at least 100 !

Some had hoped the plans would be abandoned following their election victory, but the Prime Minister has signalled his determination to deliver on a promise in the party’s manifesto.

 

As many as 19 seats won by the Conservatives could vanish as a result of the move, along with around 20 held by Labour and four of the Liberal Democrats’ remaining eight constituencies. From 13 July, Tory MPs from different regions will be called in by party officials to be briefed on the impact on their area of the abolition of 50 seats.

Within the Tory manifesto, David Cameron promised to lower the number of parliamentary constituencies from 650 to 600 as part of his pledge to “cut the cost of politics.”

 

And that’s exactly what will happen if the plans are approved.

 

 

So there would be no room for MEPs :)

Of course the Eastern European states were not happy about this. Think of the £millions that was being sent home to benefit their economy ! Do we even know if these children the money is being sent back for even exist ? And if they do, does this mean that they will now bring their families with them and put more pressure on an already straining infrastructure in this country !

 

 

Child benefit for the children of EU migrants living overseas will now be paid at a rate based on the cost of living in their home country - applicable immediately for new arrivals and from 2020 for the 34,000 existing claimants

 

 

Mr Cameron had originally wanted a complete ban on migrants sending child benefit abroad but had to compromise after some eastern European states rejected that and also insisted that existing claimants should continue to receive the full payment.

 

Why are these countries not providing better paid work for their own citizens ?

Why do we have to allow them in, in the first place ?

 

 

Home Secretary Theresa May said the deal includes "important reforms to prevent the abuse of free movement".

 

"It means we keep control of our right to decide which criminal justice measures we participate in. It strengthens our ability to deport dangerous foreign criminals. And while European countries must work together to tackle terrorism, it makes clear that our national security is ultimately our responsibility, not Europe’s.

 

The EU is far from perfect, and no one should be in any doubt that this deal must be part of an ongoing process of change and reform – crucial if it is to succeed in a changing world. But in my view - for reasons of security, protection against crime and terrorism, trade with Europe, and access to markets around the world - it is in the national interest to remain a member of the European Union."

Well I noticed that Angela Merkel was implying that they too would be thinking to apply the same formula to child benefits as the UK

 

I think she personally is worried about her position as German citizens are beginning to moan loud and clear about the amount of immigration !

I think the following statement from Michael Gove, the Justice secretary says it all for me. Too many decisions are made by un elected officials.

 

For weeks now I have been wrestling with the most difficult decision of my political life. But taking difficult decisions is what politicians are paid to do. No-one is forced to stand for Parliament, no-one is compelled to become a minister.

 

If you take on those roles, which are great privileges, you also take on big responsibilities. I was encouraged to stand for Parliament by David Cameron and he has given me the opportunity to serve in what I believe is a great, reforming Government. I think he is an outstanding Prime Minister. There is, as far as I can see, only one significant issue on which we have differed. And that is the future of the UK in the European Union.

It pains me to have to disagree with the Prime Minister on any issue.

 

My instinct is to support him through good times and bad. But I cannot duck the choice which the Prime Minister has given every one of us. In a few months’ time we will all have the opportunity to decide whether Britain should stay in the European Union or leave. I believe our country would be freer, fairer and better off outside the EU. And if, at this moment of decision, I didn’t say what I believe I would not be true to my

convictions or my country.

 

I don’t want to take anything away from the Prime Minister’s dedicated efforts to get a better deal for Britain. He has negotiated with courage and tenacity. But I think Britain would be stronger outside the EU.

 

My starting point is simple. I believe that the decisions which govern all our lives, the laws we must all obey and the taxes we must all pay should be decided by people we choose and who we can throw out if we want change. If power is to be used wisely, if we are to avoid corruption and complacency in high office, then the public must have the right to change laws and Governments at election time. But our membership of the

European Union prevents us being able to change huge swathes of law and stops us being able to choose who makes critical decisions which affect all our lives.

 

Laws which govern citizens in this country are decided by politicians from other nations who we never elected and can’t throw out. We can take out our anger on elected representatives in Westminster but whoever is in Government in London cannot remove or reduce VAT, cannot support a steel plant through troubled times, cannot build the houses we need where they’re needed and cannot deport all the individuals who shouldn’t be in this country. I believe that needs to change. And I believe that both the lessons of our past and the shape of the future make the case for change compelling."

If any of these issues were of concern, how come we didnt hear about them previously ?

 

I was also very surprised to see David Cameron slinging mud in the HoC.

 

This type of campaigning should be left to the Liberals and Labour.. they are far better at shovelling sh*T

I think ever since Tony Blair was blind sided by an audience a few years ago, politicians only speak to "invited" audiences. I would imagine that anyone who applies for a ticket would be vetted from beyond the womb !!

As has been pointed out frequently - we are a small island nation. Which, over the past 20 years or so has been changed radically - with the citizens of the UK having to adapt and change with no obligation on those wishing to come here, for whatever reason, to adapt and change with us. That is not a generalisation - but for the majority of migrants to this country, the minute they have their foot on our soil are wanting things done the way THEY are used to !

 

You might want to have a read of an article from 2002, which covers the Ugandan Asians that were forced to leave Uganda in 1972. One thing that simply lifts off the page is the acknowledgment the Asians were party to their own downfall. Aside from which, the larger amount of those expelled (80,000) 30,000 by far the largest group, came to Britain.

But some have taken the view that however wrong the actions of Idi Amin, the Asian community did not exactly endear itself to Ugandans.

 

Yasmin Alibhai Brown is a newspaper columnist. She and her family left Uganda in 1972.

 

Looking back, she says that she still misses her homeland but also loves London, where she now lives

 

"Many Ugandan Asians have similar ambiguous views - that so much was lost and even more gained when Amin banished us from a country we had helped build".

 

She says that the Asians did little to share their wealth and skills, they sent money out of the country illegally and "most Asians were deeply racist, unable to imagine marrying Africans and living with them as equals".

 

She says that the president also reminded them that relatively few Asians had been killed in Uganda but that half a million Ugandans died in the wars that began during Mr Amin's period in power.

 

She concluded that when looking back on the expulsion of the Asians, people needed to remember the truth about what happened.

Another article from 2015 where Asians are pretty much advised to look among themselves with regards to racism - against black people !

 

I noticed during some of the interviews that were done by the BBC, a lot of Asian people were also seriously against the taking of more migrants - and it didnt seem to matter whether they were asylum seekers or economic ?

 

It is my belief that migration, is one of, if not the main issue, that is being given as a reason for those wishing to exit the EU. Resolve that and you will likely find that people will not concern themselves about anything else.

I have a thing for German women. Don't know what it is, but there are exceptions.

 

I think Farage is married to a German lady, who at one time was employed as his secretary using his EU MEP expenses. Kind of ironic ,

 

My paternal grandfather married a German lady after his first wife died. She was a very nice person , sadly this caused a huge rift within the family and when he died, Nana Gita was made to feel so uncomfortable, she returned to her birth Country.

I think Greece had already shown they were not trustworthy with finances - so would they use any money provided to them for the benefit of the migrants, for the migrants ?

 

It was inevitable that Turkey would pretty much blackmail the EU into providing more cash or other benefits.

I think people have to be honest and say what in particular they don't like about the EU.

 

In my opinion, immigration is too complex an issue to blame the EU. You ask people in Germany, Spain etc what their concerns are and it will be immigration. In the US Presidential debate immigration is also a big issue. Even Mexicans with US citizenship have backed Trump in trying to keep other Mexicans out of the US.

 

I suspect in China they have an issue in some parts with cheap migrant labour from country areas migrating to cities to compete for jobs, keeping wages down.

 

Whether the UK is part of the EU or not, population numbers will increase and as jobs get replaced by technology, there will be issues. Voting for Brexit ls likely to lead to a large influx of people before the exit date. There has already been an increase since the referendum date was set. Staying in the EU means that people have more freedom of movement and they can go to live in other countries.

 

Immigration will always be blamed when the economy has tanked.. remember how Hitler came to power !

 

You have big business employing in other countries - eg call centres

zero hour contracts and cheap immigrant labour.

 

Government and big business claiming that employees in this country are too lazy ! When all business want is cheap labour that they can get shot of at a moments notice.

 

Aside from that, I find it quite strange that government say.. "Brussels/EU" say we must do this or that - that Brussels/EU is responsible for the excessive red tape - so why are government so keen to keep us IN ?

If there were a vote, 44% would vote to stay in the EU and 43% against.

The Netherlands is holding a referendum on the EU’s treaty with Ukraine on April 6. That is widely being seen as a test of public support for the European Union but will not be binding on the cabinet. Dutch MPs are concerned that concessions made by the European ministers in an effort to keep Britain in the EU will have an impact on other EU countries’ demands.

See the second graph in this article, where they are trying to get the image of an increasing leave support into the publics minds.

I find this behaviour quite sinister. The owners of the Daily Mail obviously have an interest in Brexit, which has nothing to do with the ordinary people in the UK.

 

What I find sinister is the large multi national companies who want to stay in are allowing their premises to be used as platforms for David Cameron to pimp his Remain campaign. This is not democratic, it pressures the employees into thinking their jobs might be at risk so they must vote the way their Chief Executive wants them to !

 

Why does IDS (Brexit) say we are MORE at risk of a Paris Style attack if we stay in and the Cameron Crew say we are less secure if we leave ?

 

I want to see a more reasoned debate on the issues not self interest propaganda or the promotion of fear of loss of jobs, terrorists, etc.

I hope people use their brains when casting their votes, whatever way they decide to vote. I think some people will vote on negative media stories, which only put one inaccurate side.
