    • Please go back and read my message posted at 10:27 this morning @jk2054. I didn't say that I wasn't going to provide documents, only that I will upload them to an online repo that I am in control of, and that I would share links to these. You shall still be able to read and download them no different from if they were hosted here. And, the issue I have is not so much with hosting, but using an online pdf editor to create a multi-page pdf, again I have discussed this that same message.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yodel rep, attempted delivery, so I texted the number on the card, but no reply, this happened again and still no reply. To cut a long story short I was in the next time he called, and I had the conversation regarding he did not reply to my text and he said that he was not obliged to as it was his personal phone which beggers the question, why was his number advertised on the card he put through my door then ? Any ideas ?..

They wont care. In the last 2 years with Yodel We've personally had:

 

Parcel left on doorstep in rain and marked as signed for

 

Parcel left behind dustbin in rain and marked as signed for (only time card actually put through letterbox)

 

Parcel left at an address 3 streets away (completely unknown person) marked as delivered to me and signed for. (Yodel eventually said where they had left it after initially saying left next door)

 

Parcel left 6 houses away and marked as delivered to and signed for by me.

 

Parcel claimed as signed for by me that never arrived (or was left outside or somewhere else and never found)

Yodel and MyHermes are both useless...they never turn up when they say and I've had parcels dumped outside when they could have left them in the front porch of the building. If they can't park they say they couldn't access the building.

 

We proved with CCTV that a Yodel courier hadn't been to the building - the local manager went ballistic when he saw the footage - found out the guy was stealing packages and selling them at car boot sales.

I received a package from them yesterday. The driver was polite and jolly, on time and the goods were in perfect condition. Ten minutes after he left I got an email asking how they did. Was that random? Do they give this out for every package delivered, or did the driver know something? Hmmm.

My point of course is that if the delivery driver was not going to phone me, then why advertise the number on the card that was put through the letter box..

 

Its probably required (potentially a disciplinary if there isnt one) that a number is on it, but many reasons (some even legitimate) where its NOT required to be answered ...

and there was I thinking the number was an aid for communication for the customer..

You are not their customer, the person sending the item is, you are just a third party recipient - at least that is what was explained to me when my parcels kept going astray when they were responsible for delivery. I find normal post is very effective round here.

It was Amazon with Yodel delivering the item and to which I paid for both the item and delivery. Am I still not the customer I wonder..
