    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Sorry I didn't do this yesterday, I assumed others would have remembered, then again, how many of the old guard are left?

Well, as one of the olden golden 'uns, I want to wish to CAG a very happy, well done 10th birthday wish!

Yes, dear readers, 10 years ago (and one day!), a very small with a small band of misfits and reprobates decided to take on the might of the banking industry, and it was called the Bank Action Group. A couple of months later, the idea came about that maybe, we could do more than just tackle the banks and that there were so many more injustices where the might of the people could challenge the status quo whereby the customer always ended up being wrong... and so the name was changed to Consumer Action Group.

Well, 10 years on, here we are, still going, despite numerous efforts to bring the site down in many different ways.

Even though I am no longer active on the boards, I will forever be very proud to have been part of the fight, to have helped taking the banks and other industries to task, and so, I hope you will all join me to wish CAG a very happy 10th birthday, and here's to the next 10!

Thanks bookie. There's a teensy announcement at the top but as you say, we're still here.

None of us who were around at the time could forget your cries of "it's mah mooooneeeeey" on tonight with Trevor MacDonald on bank charges, and so many highs and lows. Maybe one day that particular issue will be resolved, but we gave them a good run for our money.

I too am proud to be associated with cag and it's good to know cag is so fondly remembered. Who'd have thought that 10 years on we'd still be here having helped thousands of people sort so many problems and "reclaim the right".

Happy birthday cag and thanks to BankFodder and Dave for bringing the site to us all.

Shame that the actions of one arrogant person has soured my feelings about CAG. When one person claims to have all wisdom on an issue raised by a new member to CAG, it is a bad day for these type of forums. If you want a healthy forum, you need to have a discussion about the issues raised and not have one person deciding that they are right, deleting the posts of others.

If CAG wants to enjoy another 10 years, it will need to look at how to gain more visitors and be respected as the place to obtain the advice to help solve peoples problems. It is no good suggesting issuing court claims against companies, unless the relevant groundwork is completed first. This might mean having to send SAR's and registering complaints first. The saying 'get all your ducks in a row' comes to mind.

Many of the forums have suffered a reduction in the number of posts to them and the formatting of CAG with so many different thread folders must be very confusing to new visitors. Perhaps CAG needs to decide on a few areas of interest specialise in, rather than being a very general forum trying to cover every aspect of life.

We could do with some help from you.

Congratulations to CAG on your tenth year!

Thanks Bookworm for your birthday post. I found the site by chance when searching on line. I wish I had found CAG a year earlier as the charges refund success rate was phenonemal! I just managed to reclaim my right with one bank before it was decided to stop refunding. I would like to know how the original team was founded, an amazing story. The CAG meets have been memorable.

May the force continue:-D

  • 1 month later...

Well,i have been away for a little while and only came back on the forum last week or so and missed this thread.

10th Birthday ,can you believe it.

Why did i arrive here 10 years ago.

I know i was after help, because i was deep in the sediment at the bottom of the lake.

Polite words for deep in the sxxte.

After help from others on this site i managed to find my way out.Floated back to the top.

Just missed out on 7 k refund of Bank Charges, some woman became spokeswomen for the banks as i remember. She used to wind me up no end.

Television then were heavy things not 2" wide as now, only reason it did not fly through the window at times, heavy beast.

She Moved on i think to the energy companies but not sure.

But everything stopped, teach me to take so long to act.

But had many other problems as well, ended up Repossessed,Bankrupt, and company dissolved faster than a greyhound after a Hare.

But remembering what could have happened without the help i received i do not want to think to hard about.

I am still here 10 years on,which i had not realised makes me a first year member.

Which makes me happy.

All the names who have said something on this thread i know to some extent through their posts.

Bookworm i remember reading posts and threads and the info given and was fascinated with the support and advice given.

Ell-enn and many others, thanks very much.

Sorry for going on a bit.Nature of the Old Owl.

And i do take time to say things so what i came to say that took so long is Happy Birthday and really let the party last all year long with specials to celebrate this fact.

What specials you may be thinking,i do not know i am not that wise, but i bet some of you are.

And as indecision is one of my weaknesses i could not decide which song to put on so picked a few, something for everyone.I hope,i think anyway:-)

Tawnyowl over and out.

Last thought-I know it is not about money helping people, but i wonder what the total refunds etc, etc, etc the CAG has got back for people, saved them from god knows what as well.

The end,i am off now.Just checking the date i joined can you believe it,10 years.

the lady:-)

Glad i was not the only one who got a little wound up by Angelas expertise in smoothing things out for the Banks.
