      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've been wondering how you're all getting on

 

So, nothing from Mr HSBC in the post then? We had a local news story down here about a woman who took the high street bank to court and I was all AAAAAAAAGGGGGGGHHHHH but it turned out she had got all her charges back and was trying to sue for distress - it got thrown out though

The only fixed costs you can claim are if a solicitor issues the proceedings on your behalf.

Still nothing from DG for me - grrr! Ho Hum! D&G only have 14 days to send the AQ & sort their defence out:D I'm still fairly disgusted how little attention HSBC pay us folks - we're taking them to court for goodness sake - they've made a mint out of us - you'd think it'd count for something!! They're off my Christmas Card list anyway!

Hey Babs, (have to watch that typing LOL)

 

Got a papaer copy from the court today confirmimg that hSBC have acknowledged my claim, and guess what - the box saying the intend to fully defend is nciely ticked - eek

 

Would it be prudent of me to pre-empt them writing and asking for a breakdown of costs to beat them to it and send one to their Edgbaston address ?

Also it seems as the same person (Deborah D'Aubney) is dealing with - gosh she must be BUSY !!

Maybe I could send her an xmas card as well LOL

Just read this thread, oh jeez, I've submitted my MCOL and received acknowlegment in the post today. Defendant has until the 9th Dec to reply! Knowing my luck, I'll have to go to court, surely they must planning a defence mechanism with the volume of claims being submitted?!!

A bloke i was talking to told me that because of the volume of claims, he heard that there will be a loophole soon so that banks can get out of paying the charges out! I don't know how much truth there is behind that story, but I'm going to be getting all my claims done in the next 6 weeks I think!!!

There is no truth in this. These rumours circulate every so often and if you look back through the earlier threads. The last one I can remember was in May and Barclays staff were saying that they had found a way out of it and it would all stop by June.

 

Besides, by definition, a loophole has to already be in place to be exploited. An institution can't just create a law which gives them an advantage. If such a loophole was already in place then logic dictates the banks would have exploited it long ago and saved themselvesa few million quid.

The only thing that could stop the banks paying out is a precedent set by the court, (this can't be done in small claims), and seeing as how the banks never show this is unlikely to happen.

Isn't it weird, I got exactly the same letter from Debs in the post last night too saying that they intend to defend, also got a letter from Colin saying they'd pay part of my claim back. What a coincendence, I'm guessing Tuesday must be their letter day or something! I've just writen a lovely letter to colin saying thanks but no thanks and am just now waiting for D&G to come back and ask me for me schedule of charges. Not long now eh? But am guessing it'll be after xmas before I get any dosh back. Oh well!

DON'T wait to send charges breakdowns to DG - get them sent ASAP as it looks like it might just speed things up.

 

Look at this - Abba the horse was really organised & after DG had acknowledged his MCOL & said they intended to defend in full he sent his breakdown off really quick & with still 2 weeks before they had to file on the 28th day DG have offered him full & final settlement!:p

Don't be stalled by DG - send them off sooner rather than later!
