      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

How long did this come after filing MCOL and have you had to send a breakdown of charges yet?

Been reading this thread.......got my letter from the court with the usual tick in the defence box!! I didn't realise we could just send another copy of the charges to the solicitor Deborah D'Aubney even though I've sent a set to the court. Will send another copy tomorrow. Just a quick question....do I just send the charges quoting the claim number from the court etc? Also will I need to send copies of my previous letters to her? Apologise for intruding on your thread Babs

Amanda, I think the box they tick is the normal process, it doesnt actually mean they are defending, just intending too so dont panic just yet!!

 

I just wrote a short letter to DG saying I thought these maybe helpful to continue with the case and that was it really!

 

So how much are you claiming and when did you do your MCOL?

Thanks for all your good wishes - no sign of the cash as yet though! No computer this weekend so haven't been able to reply to anyone til now - it's not even in the bank & it's going down already!

 

I'm surprised you haven't had anything yet babs - even the replies from D G are random!

Hi ALL,

 

No letters here either (unless Babs dog ate them) funny how the brown evolope ones (bills etc) ALWAYS get delivered VERY efficiently !!

 

I'ts killing, worse than sitting on death row (so I'm told) waiting for the postie to deliver, must be all those blinking xmas cards - why oh WHY didn't I start this back in the summer !!!

Hey you....don't go casting aspertions...(not so hot on spelling) on my pooches! :p

 

It's payday tomorrow here and its soooooooo depressing knowing that a huge chunk of my hard earned cash is going straight to Mr HSBC in this months charges and O/D fees...grrrrrrrr can't wait for the tables to turn turn turn.....

im really sorry i dont really know how to post a thread and im really getting confused but ive done a really stupid thing.

 

i filed my money claim online form and put myself as the defendent when i m the claiment - can i change this without losing my £120 please please please help and if you can please message me im so panicked!

Q. I have made an 'obvious' mistake on my claim, I entered myself as the defendant and the claimant, what should I do?

A. In this situation the mistake made is obvious. You can withdraw that claim and issue a new correct claim rather than applying to amended it. You should e-mail or fax the court requesting to withdraw the original case with your reasons and request a refund. You must quote the new claim number and your name and address so a payable order can be sent out. This applies to situations where the claim is a defendant vs a defendant, a claimant vs a claimant, or the defendant and claimant details have been entered the wrong way round

 

Phone them tomorrow, if you can't withdraw it, you can amend your claim for £35 (unreclaimable)

Thanks Babs, between the two accounts I'm claiming nearly £4000! Nothing in the post today, sent my copy of charges to 'Debs' yesterday by recorded delivery.......still waiting!!! What's annoying with these banks that even though you're overdrawn, they still take their charges!!! In fact, just had a discussion with the bank requesting an explanation to my charges, the girl started stuttering and couldn't offer any explanantion, went to seek her supervisor and after she kept me waiting for ages and I disconnected the call!!! What does that tell you!!!

The waiting is just too much! Im really tempted to ring Dg and make sure they've recieved the list of charges and see if I can get some info out of them! I just cant bare waiting!

 

Im starting to wonder if it actually makes it any quicker to fax or send the breakdown of charges before being asked. In the cases Ive looked at so far the letter requesting beakdown of charges usually comes around 2 weks after MCOL is filed Well mine will be 2 weeks Monday and not a peep from anyone!! Or maybe its 2 weeks after acknowledgement which would be a week today.... who knows! The only thing I know is the wait is killing me! Thank goodness for work and the kids keeping me busy!!

i once had a girlfriend from a very well off family who told me once that she thought being poor looked like fun! :o i told her it most certainly wasnt and very soon she found this out aswell, the moral here is try not to be poor. i imagine most of you have gathered this already though henceforth why you are here :)

We should all be positive. David has had an offer thats a start! Defence due on mine next Thurs. I expect to hear between receipt of that and filing the AQ so it may be just after Xmas when Im credited with the dosh but hey I can write another of those cheques that cost me an Additional abuse charge for the turkey!
