Do i still need to send "rejection of settlement letter"??

Hi all!

 

I sent off LBA and they responded with there standard "thanks for complaint can take up to blah blah blah to respond". They didnt offer me any setllement at that time so i filled in in MCOL on the 20th Oct (which i told them i would do). They have sent a partial settlement letter nearly 2 weeks after the deadline date (20th oct) that i told them i would file my claim.

 

Do i still need to send them "rejection of settlement offer" letter?

I was reading on the notes before the letter and it says

 

If their offer letter arrives very close to the expiry of your LBA expiry (perhaps within a couple of days), you can proceed with your claim without sending another letter - they have effectively denied your claim and you would only be extending the timescales.......

Im sure it may seem obvious but just wanted to confirm that i dont need to send them rejection of settlement offer letter, or do i still?

You can to be on the safe side if you want but I didn't with my claim with Barclays. Just went ahead on my deadline and filed.

Barclays - Prelim Sent for £980

23/09/06 - LBA sent for £1000

05/10/06 - Received offer of £500

10/10/06 - MCOL Served for £1244.01

18/10/06 - Acknowledged by Barclays

20/11/06 - AQ Returned to Stockport Court

REFUNDED IN FULL

Capital One - Received Statements

Prelim sent 20/10/06 - £632

Offer received 03/11/06 - £248

Partial settlement and LBA sent 07/11/06

2nd letter from Cap 1 18/11/06

MCOL filed 21/11/06 £864

WON! REFUNDED IN FULL

Halifax - Received Statements

Prelim sent 09/10/06 - £836

28/10/06 - Offer received £568

Settled.

Egg - S.A.R - (Subject Access Request) sent 22/11/06

I have recieved a letter offering me a partial payment of £600. I am claiming for £1300. I have just recieved a letter telling me they have regected payment for my mortgage after going over my overdraft by £20 and that they have charged me £30 for the pleasure. Can I add that to my claim? and how do I let them know that? Do I add it to my letter of rejection? as I am going all the way with this as I'm very p***ed off.

you can continue to add in their charges until you actually file court claim.

By all means add it to your rejection letter.

I dont know how to start my own thread?? This site is soo confusing!

Im at the stage of filing through the small claims court on line & Im unsure of some of the questions??

 

Im asked 'Does or will your claim include any issues under the Human Rights Act 1998?' Do I answer Yes or No??

 

Please someone help.
