    • Afternoon all Looking for advice before I defend claim for car tax payment that the DVLA claim I owe £68 from an idemity claimback from my bank and unpaid tax  brief outline. Purchased car Jan 30th ,garage paid the tax for me after I gave them my card details  first payment £68 out in Feb 24  followed by payment of £31 from March due to end Jan 24 Checked one of my vehicle apps and about 7-10 days later car showing as untaxed? No reason why but it looks like DVLA cancelled it , this could be because I did not have the V5 and the gargae paid on my behalf but not sure did not receive a letter to say car was untaxed.  Fair enough I set up the tax again staight away in Feb 24  and first payment out Mar 31st , and each payment since has come out each month for £31 , this will end Feb/Mar 2025, slightly longer than the original tax set up, all good. I then claimed the £68 back from my bank as an indemity refund as obviously I had paid but DVLA had cancelled therefore it was a payment for nothing?  Last week recieved a SJP form dated 29th May stating that DVLA were claiming for unpaid tax and a false indemity claimback which of course is the £68. It also stated that I had received two previous letters offering me the oppotunity to pay that £68 but as I had not responded it was now a court claim that I must admit guilt for or defend. My post is held for weeks at a time from Royal Mail ( keepsafe) due to me receiving hospital tretament at weeks at a time that said I did not receive any previous letters from DVLA. I am happy to defend this and go to court but wondering what CAG members think? In summary I paid an initial amount of £68 and then a DD of £31 , tax cancelled  I set up a new DD at £31 a month all in the month of Feb 2024, I claimed the £68 back from my bank. DD has been coming out each month without issue and I have paperwork to show the breakdown for both DD setup's plus bank statements showing the payments coming out . The second DD set up has extended payments up to Feb/Mar 2025. DVLA claiming the £68 was ilegally claimed back despite the fact they cancelled the original DD for reasons unknown. Is this defendable ? I will post up documents including the original DD conformations

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

8 months ago bought a battery paid for it to be delivered. It arrived flat/under charged ( no green ball showing ). Someone came round and changed it - acting so "surprised" trying to make out the recharge date was the date of manufacture. This is rubbish. So my brother fitted the new one himself. Fine.

 

Present: MOT done at Chandlers had £400 of work done... brother mentioned it did fail to start sometimes. They found nothing. 2 weeks later it failed again - I left the car with them, they replaced the alternater and said the 8 month old battery was no good after charging me to test it another £400 of work on top of the other. I thought this should be it. The day I drove it off my stereo flickered on and off and the lights dimmed. I telephone Chandlers and was told the alternater and the new battery just fitted would have thrown up a new fault. I wasn't convined as it seemed a common battery fault. On opening the boot and removing several panels I looked at the battery and there was no green ball; in need of a charge. I took my car back at 11:50 saturday morning and this was agreed by a member of staff, I asked for a new battery and offered to fit it myself! He agreed and took it into the service area then in the car park I was confronted by another member of staff and told to bring it back monday and they would test it and see if it could be done under warranty! I thought he was joking he was slightly imtimidating, I asked to speak to someone in charge. I explained everything to her. The lady in charge said she would try to arrange for someone to come round to where I work.

 

This is terrible service and surely there must be something I can do. Under the sale of goods act? As this isn't what I'm paying for?

0800 777 111 if your car is under warranty, that's BMW emergency services. Make sure you say you want one of their own techies to check the fault, they carry a very sophisticated portable diagnostics machine.

 

Or if you don't have the assistance package anymore, call them anyway, explain the problem and tell them you want Head Office number to complain (in Bracknell).

 

BMW want to keep the image of the product where it is, they hate it when they get complaints about their franchises. Making a BIG fuss, especially is staff's been rude, is more likely to get you somewhere with BMW than with most companies. ;-)

Thanks phoned the number above and was given customer service 0870 5050160 - She said she doesn't know why they didn't just change it there and then, especially as it was already on the ramp!!! so she admits it stinks!

 

She suggested wait till monday get them to fix it and then phone up and explain about service.

 

Also is it possible for an alternater to destroy a new battery in 8 months??

It was apparently running 1% below what it should be

I've had the same situation - not with a car, but a motorbike. I ended up having 3 new batteries fitted, each one not lasting more than 16 weeks or so. Each time I started the bike after 3 days in the garage, it wouldn't start and I had to top-up charge the battery. I gave the dealer all sorts of abuse for sourcing carp batteries and charging me top whack for them. The swaps were free, but the problem continued.

 

Eventually, the bike failed its MoT test - they couldn't start the engine to put it on the rolling road, and I went ballistic. We now just couldn't start the thing, even with a charged battery. Stripping down the bike in the workshop the dealer found one of the main cables that takes the power from the battery to the handlebar control panel was seriously corroded, so much so, all power from the battery was leaking to earth inside 12 hours. The battery just didn't have a chance!

 

This is the first I'd heard of this problem, and thought it worthwhile passing on - it MAY NOT be the battery that's the cause of the problem, an earth leak is more likeley due to the repeatability of the problem.

I have gone through hell with this lot! They have since come out again replaced the alternator and not the battery!!

 

I don't want to go into it all over again. However as I paid with a credit card couldn't I just ask my credit card company to refund this to me?

 

As I have paid for something and it hasn't been done.

Touble is the merchant could say that it has, and you say it hasn't - the card company wouldn't entertain a Section 75 refund on that basis. You'd need to go to a different garage for a written statemnt that the part was or was not a recently fitted item.

Well as I rang Head office I got call back and whereas before I was offered £1,000 part exchange even though I had just spent nearly a grand!! Head office arrange for £1,000 off straight off and another £1,000 if I want part exchange.
