  1. Received a letter from solicitor that their claimant wants to proceed with the claim. They have attached a copy of the claimants completed directions questionnaire. Can’t believe they want to proceed! Literally one tyre over the line in a free car park. I’m happy to go to court

  3. This was my first try 1. The Defendant is the recorded keeper of [motor vehicle]. 2. It is denied that the Defendant entered into a contract with the Claimant. 3. As held by the Upper Tax Tribunal in Vehicle Control Services Limited v HMRC [2012] UKUT 129 (TCC), any contract requires offer and acceptance. The Claimant was simply contracted by the landowner to provide car-park management services and is not capable of entering into a contract with the Defendant on its own account, as the car park is owned by and the terms of entry set by the landowner. Accordingly, it is denied that the Claimant has authority to bring this claim. 4. In any case it is denied that the Defendant broke the terms of a contract with the Claimant. 5. The Claimant is attempting double recovery by adding an additional sum not included in the original offer. 6. The Particulars of Claim is denied in its entirety. It is denied that the Claimant is entitled to the relief claimed or any relief at all.

  6. Great, thank you. I'm afraid I didn't keep the original documents. I thought they can't seriously take me to court for not parking in a single bay perfectly. I will upload pictures it won't have been parked in the middle or anything like that. It was ridiculous. I've done the confirmation and completed the letter for the solicitors. I'll post first class tomorrow. I'll keep you posted. So just need to file a reply by the last day of the date.

  9. Just received a court letter. We park over the lines in the free parking. It wasn’t in the middle but it is a big car. Can I dispute a punitive charge?
  10. You do realise that our children are usually within 1mm of us parents for long periods of time. If we have the virus. There is zero chance our children wouldn’t have it. Our children then run up to the staff and are within 1mm. I just see it as the staff are exempt then they make an exception but parents don’t get the same rights.
  11. Hi my gf is exempt and picks up our kids from nursery. The nursery since today decided she can no longer enter the building and must wait outside for drop off and pick up. The staff were incredibly rude and told her go round the side if she doesn’t want to wear a mask. She explained (again) she has an exemption. They said the staff if exempt won’t be wearing a mask but if parents exempt or not must wait outside. surely they can’t make her wait outside simply for being exempt?
  12. I have managed to get through to someone and they said they hadn't received. The court papers or the warrant .... they would normally ask the court for a stay - but they would on this occasion prefer to settle it. They will send a cheque in next few days.
  13. No one seems to know who to speak to or who to transfer me too. I don’t think they seem to have a legal department...
  14. Yeah I did look at high court but the charges are too low. I’ll call Sainsburys now and ask for legal department.

I used webcheck to get the head office address and checked the name was exactly right Sainsbury's Supermarkets LTD 33 Holborn London EC1N 2HT I used my Monzo debit card and the original amount was £145.64. I didn't claim for interest as I assumed they would pay up quick. Wish I had now as this has been ongoing since October / November. Monzo said they won't do anything without an invoice but I didn't have an email confirmation as it never came through. I would be happy to do the bankruptcy petition. But not sure exactly how I would go about it. The court did say it can take 6 weeks or more and that December they won't work over Christmas as it isn't nice to do it at that time of year. But the warrant is dated 21.12.2018... we are now 04.04.2019!
