    • Thank-you @BankFodder, your statement is a correct understanding of my position and I agree, it is actually really what I was looking for in starting this thread, as I too believed that the maximum I could claim for is that which I sold it for, even though this was substantially below market value at the time. And so, this sold value is what I shall be claiming for + the other expenses. @dx100uk I get your point, but this is just not what I want to expose myself to. Unfortunately I was one of the unlucky ones to have my details stolen in the Peoples Energy hack, and in 2020 I discovered that those details had been used to take out car insurance, and that the insured was then involved in a collision and my details were dragged through the mud. Despite Aviva cancelling the claim and treating as though it never were, even though I have the letters from them to say that they have removed this claim from the insurance database, I still get refused insurance and credit products to this day until I send across the letter from Aviva which explains that I was a victim of fraud. So you'll forgive me for not jumping up and uploading my data to a server utility for which I have no control over its retention policy, or where the server is located globally, its legal jurisdiction, or its security protocols.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Did you initially apply via a paper claim or was your initial claim done over the phone.

 

Or have you completed the second part of the application which is the more detailed claim form?

 

Unfortunatly there is no "time limit" for PIP claims to be dealt with. However you may want to make a FORMAL complaint to the DWP and the face to face consultant provider.

 

Making a formal complaint.

 

-Contact the manager at the office dealing with your claim telling them what happened, how it has affected you and what you want to happen to put things right. They should resolve the issue over the phone or deal with your complaint within 15 working days.

 

-If you are not satisfied with their response you should be asked if you want your complaint to be sent to the Director General of Operations for DWP who will aim to deal with your complaints within 15 working days.

 

-If that does not satisfy you, the next stage is to ask the Independent Case Examiner, PO BOX 209, Bootle, L20 7WA

Tell number 0845 606 0777

They can look through your case if it relates to maladministration. They cannot look at disputes as a result of legislation and instead in those instances you should use normal appeals and reconsideration process. (But atm this last bit does not apply as you have not even had a decision yet)

 

Failing the above, if the case is still about maladministration you can write to your local MP and have it referred to the local government ombudsmen

 

 

FYI Maladministration does include "Unreasonable Delay"

 

You might want to research as part of your claim asking for "Interest for delay" on any payments due and also Consolatory payments. You might be able to claim a spacial payment to help cover losses or expenses due to maladministration buit you will need to show proof of those.

well i just got of the phone to them, they told me they are starting to send letters out to the one's that have been waiting a long time, and that i/we should get a letter soon......... How true this is!........ just have to wait and see what comes.

hi cliam form sent nov 12 2013 dwp got it atos got it 5 dec 2013 no news at all m p has witten one month ago she still not heard anything back from them either is this a record

 

my claim took 13 months, so you have a bit to go before you break that record

hi all just some info about what to expect from atos assisment excuse my spelling

 

i have m h and osterarthritis ibs and seizures on 11 meds plus control med

well my appt was for 1.30 got their at 1.15 1.40 no sign of calling me by the way i had a m h lady with me from mind she ask why delay next i was called young nurse was very polite she said sorry that she had a load of notes to read etc the lady gave her new letters from my consultant as when i filled the form ibs and seizures was not on there i am waiting 9 months for this anyway back to the assisment she ask me about my mobilty and mh how it affcted my life how did i sleep how did i cook did i look after my meds did i need help dressing she had my form on computor she went from page to page as to what i written down on the form then she ask me to sit or lie on the couch she had it low so i ask her to raise it didnt hand me my stick i had to ask her for it little things like this trip u up then had to squeese her hand then she ask me to repeat 3 words which i did then which i found strange she ask me to subtract 7 from 100 down all the way confused by now i coulnt that was it she took us back to the front reception photo copied my lastest letters from drs then said good bye thats it if you to ask me anymore questions please do

thanks all just to add they seem so nice etc it is to drop ur guard be carefull ie not handing my stick to me it fell on the floor if i had picked it up which i could have not she would have noticed that when i was waiting on the return cab the 2 girls on the front desk kept a watch as well the lady that came with me noticed this go through ur form that u filled and dont be bullied like what she said to me , but can do ur shopping and cooking cant you smiling at me be strong will let u know when i get it or not she said it might take a one month to hear

if i wanted phone the dwp after that if u want to claim ur transport u have to phone them before you go the will ask why u need a taxi etc when i had my assiment she knew that i was claiming expences as ask why come by taxi be carefull but tell the truth god bless

well claimed in nov 2013 got a f2f atos on july 7thafter getting mp help phoned dwp yesterday30th july they had the report on the 10 th july should hear in 3 weeks from the date report recieved to day got a letter to say got all reports and will contact me shortly the letter was dated 23 rd july its taken a week to get to me when can i expect a letter now i surpose a month b4 i call gain any ideas ps live in the london area
