    • Hi I assume the Loft Conversion with the eaves and crawl space was there when you initially purchased the property. Even in done after purchasing the property and the correct permissions were in place i.e. Local Authority, Land Registry, Freeholder which is Southern Land which would be required as a Leasehold property. The difficulty is if the Loft Conversion was there when you purchased the property and there is no evidence in your documents of the eaves and crawl space due to where the Red Lines stop in the plans or even after purchase it was added this is the reason you are having issues with selling due to those missing Red Lines in the Plans and any other Buyers competent Solicitor would flag this up. I can understand the reasons the Buyer wishes a Deed of Variation probably there Solicitor requesting this to ensure those missing red lines are covered before the Sale as they Flagged this as an issue as Red Lines missing on Plans and want buyer protected. As for the £8000 costs Together and cohort Southern Land are trying to charge have you thought of contacting a few Property Solicitors yourself to get a few quotes. (only mention this because when I research this possible costs can range from £500 - £2000 depending on the Deed of Variation work required and nothing to stop you doing this then approaching Together and cohorts with it) Also ask Together/Southern Land for a breakdown of the £8000 costs for the Deed of Variation. Yup do send both Together and Southern Land a Subject Access Request (SAR) requesting 'ALL DATA' that simple phrase covers whatever format they hold that data in whether it be emails, written, recorded calls etc. They then have 30 Calendar Days to respond and that time limit only starts once they acknowledge receipt of your SAR Request. When you purchased the property some 17yrs ago are the Solicitors that you went through at that time still operating?     • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hey folks

 

this is mainly for infomation,

This is the second PPI claim I have done.

 

Many years ago previously I had a graduate account and a large loan attached to it

and was sucessfull in getting full refund of premiums paid PLUS interest and the remaining PPI removed from the loan.

 

I have recently discovered evidence of PPI on my flexi loan from when I was a part time college student

and before I took out the graduate Loan.

(PS i was at college from 16-20 before some of you thin kI had a loan before I was 18)

 

Details Below. Comments and Questions Welcome.

02/04/14 - Letter submitted requesting details of the flexiloan and all charges and information regarding it.

Enclosed included the FOS PPI questionnaire completed,

Copies of A statement for the flexiloan,

A personal summary listing the flexiloan account number sort code etc,

It also displayed the POLICY number.

 

14/04/14 - Letter Received saying they were unable to find the records I asked for from the details given.

Requested I "Re Submit" the request with correct hsbc sort code and account number.

 

14/04/14 - Reply sent to HSBC enclosing the following copies,

Original Letter of complaint,

Their letter received this day (dated 04/04/14),

Financial statements showing the flexiloan repayments,

the financial statement showing the policy and loan.

 

I also enclosed copies of additional flexiloan statements 09/10/03 to 08/12/03 and 09/12/03 - 08/03/04.

 

Also enclosed 2 current account statements showing the flexiloan repayments and also charge for "Loan Insurance"

 

In the letter I stated that my original request still stands and that this was NOT a resubmission.

I also reminded them that they could get the information regarding the charges from the Loan insurance from my statements

 

25/04/14 - Letter dated 22/04/14 received from Ross Dear, Wealth Complaints Officer stating that my signature

and address did not match and would not be able to investigate my complaint further until I proved my identity to them

by going to a branch with ID and doing a sig change with proof of ID.

 

I decided to humour them. (My HSBC account has previously been closed and along with my HSBC Credit card are being paid off £1 a month.

Third parties and other inhouse agencies had been passed my current address by HSBC

and had been happily to correspond and make arrangements to pay etc.

 

Lady was a bit bemused.

Filled out a signature thing and took copies of my id etc.

Refused to give me any proof that I had been there and complied.

 

Letter sent to HSBC same day.

Stated that Under DPA/CCA I didn't need to supply signature.

Added reference to my visit, named time date, branch etc.

 

Challenged them on why they were asking for ID when Metropoliton Collection Services,

a member of HSBC Group had been happy to correspond and make arrangements etc with me.

I also enclosed copy of Council tax Bill and passport copy.

 

Letter also told them I was getting Frustrated with HSBC continuing to use Various delaying tactics to avoid resolving my complaint

and that I was sticking to the original timescales laid out in my complaint dated 02/04

which meant 8 weeks to resolve my complaint and 40 days for the information requested.

Failure to comply would result in me referring my complaint to FCA and ICO

 

So I expect to have the information by 14/05 and the complaint times out 30/05

"Thank you for your recent correspondence. I am sorry that you have found it necessary to ocmplain about Payment Protection Insurance. We are looking into the issues raised and will contact you again shortly regarding how this complaint will be dealt with.

I am a bit stuck at the moment, untillt hey comply with my full SAR request I do nto have the figures to claim the payments back or interest grrrr

15/05/14 - Letter received today dated 13/05/14 from my new friend Vicky. Same letter as 12/05 :/

 

lso received today was another request for me to go into a local branch and prove my id in responce to my SAR despite them saying on aprevious letter they were processing the transaction lists. ( I sent a the payment back again with original complain and told them to complete my original request)

 

Everything scanned in relating to SAR and 4 page email complaint with attachments sent to ICO

 

Also sent an edited version of the ****tagram I sent Natwest.

 

oh Hang Sheng Bank , get your act together :?/

 

 

PS has anyone claimed PPI with interest in restitution on a HSBC flexi Loan yet?

The good news is that I am not too reliant on the SAR. I have 90% of the current account statements showing the PPI charges from the Flexiloan. I can reconstitute the remaining gaps easily enough. As they are dragging the ppi complaint on (which consisted of the FOS PPI questionnaire and a cover letter requesting they find all the PPI charges) is it time for me to formalize my complaint further?

 

NB my cover letter requesting the PPI info was separate to my full SAR request.

17/05/14 - Letter dated 14/05/14 received from HSBC

 

"Thank you for your request for the provision of personal information. This was accepted for processing on the 12th May 2014.

 

I note your comments made in your letter of 7th May 2014 but please note there was a discrepancy in the signature on your original request of 17th April 2014, a standard charges response was issued as this is free of charge and infomation is usually provided quicker than the statutory 40 days under the Data Protection Act 1998

 

However as you have now updated your signature at Cosham Branch and your letter of 7th May 2014 included additional I.D, I can confirm that this office has instigated a search for information on your accounts as stated on your request and in accordance with the Data Protection Act 1998.

 

The Data Protection Act allows 40 days from receipt of your completed application by the bank for the processing of your request. For security reasons the data will be dispatched on or before the 20th June 2014 to an HSBC branch or, alternatively, you will be advised if no information is found as a result of the search.

 

Please advise this office of the most convenient HSBC branch for you to collect any information located by completing and returning the attached form.

I have a love/hate relationship with HSBC.. I love to hate them and anthing that brings this company to its knees is good for me !!

 

Absolutely DO NOT give them your telephone number. It sounds like there might be a lot of data if they want you to collect it.

 

I ended up sending OH's PPI complaint to the FOS which took nearly 3 years (because there were other issues as well) to resolve, so he only received the PPI/interest and the 8%

 

Just so you are aware and can keep your eye on them, the statutory time for complying with an SAR is 40 calendar days.

Unfortunatly one of their departments requested id again few days ago so i did report them to ico.

 

my reply reminded them that my complaint has already been received by ICO and I expected completion within the time scales from my original request.

 

When ico give me a case number they get the above letter too ;)

You will only get interest in restitution if you sue them in court for mis-selling the PPI. You won't get it via the standard regulatory route.

I would wait and see if they make you an offer first. You never know, they may uphold your complaint first hit.

I actually have most of the statements bar about 5 here and there. I have now found first payment and when the loan was paid off.

 

The ppi was a fixed amount per month charged to current account.

 

With that in mind I have managed to reconstruct what was taken.

 

But I agree on waiting to see what their first response is.

If you plan to sue them instead then you control the timescales.

Letter received today, please see attached.

 

The reason they do not have my phone number is a few years ago they removed it form their files in response to a formal complaint from me re_Auto dialers calling me for arrears that did not exist.

 

I loth to hand them my phone number

 

Any suggestions? I do not wish to talk to them over the phone in any capacity.

You do not have to give them your phone number. You should insist that all correspondence is in writing so you can refer back to who said what and when.

You recently sent me a letter dated 28/05/14 requesting that I provide you with a phone contact in order to resolve my complaint more quickly.

 

The reason HSBC does not hold a copy of my phone number is because your company upheld a previous complaint of mine where I was being harassed by your auto dialling system for a non-existent arrears and as such removed with my permission the number from your records. It is not fair for you to request that I be put at risk of that psychological stress again.

 

Therefore I request that all correspondence be in writing.

 

I also fail to understand what further information you could possibly require considering I have provided the loan account number, the correct account to which the loan protection payments were charged to, the policy number and a few statements of the loan account itself. I have even pointed to how you can gain the information required to investigate my complaint.

 

If you require further information please let me know however I have fulfilled more than necessary required to prove the existence of the policy as stated by FOS guidelines.

 

I also expect this complaint to be resolved within the 8 week period. If this is not resolved to my satisfaction I will refer to the FOS

Whats more, as they sent with that letter the freepost return envelope I only had to pay £1.10 fo first signed delivery as they had already paid the postage XD

I loved the idea so much that I copied - well, almost. I got a letter from the Halifax telling me they may have mis-sold PPI. They supplied a pre-paid envelope to send the forms back, which I used at the end of April. I copied it all first, envelope included, so was able to reconstitute the image and print that on to a blank envelope in which I sent a reminder letter the other day ;-)

I reconstituted it - I'm pretty sure that's allowed, or so the DCA's tell us... :-)
