VCS letter received. Can you help please

The POPLA code will be generated from the date of any rejection letter, or should be. It should reach you within 2 working days of that date.

 

They should if they comply respond within 35 days.

You will have 28 dasy from the date of the issue of the code. This is why a few companies argue the toss and it delays the sending of the code so you get less time to make your case to POPLA. Just futher evidence that they dont like having a light shone upon their practices.

Hi all

 

So the 35 days from date of appeal is today. Obviously, as there is no post on a Sunday nothing has been received. However, if there is no response from them by end of tomorrow would you recommend contacting them or should we wait longer? Also, Ericsbrother, re your last post, if they don't provide the POPLA code with the rejection of appeal and we need to request it, does this eat into the 28 days we have to appeal to POPLA?

No, they are timed out so you now ignore them. They cannot have it both ways. If they do get in touch complain to the BPA about the abuse of process and the breach of the PoFA in an attempt to make false claims. I wouldnt accept it if the BPA gave them another chance to send the code-stuff them, their own fault for being useless at their own game. If they contact you now, reply to them that they have failed to follow the procedures and they can no longer claim against the keeper of the vehicle and any attempt to do so will result in a counterclaim for harassment. Counterclaims are better than starting you own action as they have to pay their continuation costs if they dont want to lose by default so it will go nowhere.

The parking space is your son's, not VCS's so at the end of the day they are wrong to start anything so it doesnt matter what they say and Ibet they will now skulk off having failed to cream some money off someone who doesnt know what is what. your son should now be a little wiser and next time he can tell them to get lost and stop their trespass and harassment from the word go.

VCS do sometimes take longer then the 35 days to respond. They know the rules but like to bend them.

 

Or they have realised they are on a loser and saved a stamp.
