NIP states no speed

My OH got a NIP the other day but it does not state what speed he was allegedly going. It states he was speeding on motorway where speed limit was reduced to 50mph due to roadworks but it was at 1.30am and the roadworks were in complete darkness. How can he admit speeding when they have not told him how fast he was going.

 

Any advice please?

maybe he went through one of those "average speed" sections,if you enter and leave the section in under a certain time you must have been speeding.

At the moment he's not being asked to admit anything other than to say whether or not he was driving the car at the time. By completing the form he's not admitting that he was doing any particular speed, or even exceeding the limit.

 

The NIP only has to state the nature of the offence, which is exceeding the speed limit. It doesn't have to state the speed alleged. Indeed it's not necessary to prove the exact speed you were doing to convict you of speeding, so long as they can prove that it was ore than 50mph. For example, if a,police car was doing a steady 50mph and you overtook it, that wild be enough to prove that you were exceeding the limit. It wldn't matter whether you were actually doing 55, 60, 70 or whatever. That said, there's a 99% chance that it was average speed cameras which gig him and they'll be able to state the exact speed if required.

 

The speed limit applies 24 hours a day. It's mildly annoying having to stick to 50 at 1:30am when there's nobody working on the roadworks... but the fact that you don't agree with the law doesn't give you licence to break it.
