      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

Just received 4 boxes from HSBC following SAR letter.

 

So, first and foremost - there is no contract!

What does this mean???

and what do we do...

 

Here is our situation:

My husband had this account for 15 years.

 

About 7 years ago it became joint after we got married.

 

For years, this was the only bank we used.

It went in and out of overdraft.

 

But about 5 years ago, we stopped using it.

 

However there would be an occasional charge and/or direct debit which would keep the overdraft going.

This made the account go from 0 to 9K, which is out limit and for the last 3 months it's over the limit,

now they are demanding payments and reported this on our credit file.

 

We tried on numerous occasions to resolve, settle, come to an agreement but were always told that nothing can be done

and it's all fine as long as we are under 9K.

I even tried to close, but no luck...

 

a few questions. PLEASE HELP!

- No contract - what do we do?

- A number of accounts listed with closed dates unknown

- Fees/etc - what are we supposedly to be looking at and how are we adding this up? There is a min of £150 monthly, plus £12.95 ppi

- How far can we go back?

- Letter template?

- Personal issues? What are the types of things we should mention?

- Difficulty - We were in financial difficulty for years,

this account above contributed to this, in addition to other cc mishandled..

. However now we are doing ok and focused on repaying everything.

Does our current financial status matter?

- We are not currently living in UK - does that matter.

 

PLEASE HELP! ETERNALLY GRATEFUL FOR EVERYONE'S HELP HERE !

It's a current account they will not be a contract has such ,

if you were experiencing financial difficulties when the charges were added to your account

you will have a better chance of getting charges back .

 

If you are claiming ppi back

 

I got ppi back from a mortgage I started in 1988 and ended in 1994 also a loan taken out in 1992 _1995

so start claiming ,you can find all letters in the library at the top of the page.

Is there a letter for Charges/Interest Fees? Can I claim these back?

Can I combine PPI claim and charges?

For financial difficulty - what do I need to prove it?

You will find the spread sheet that you require for both PPI and charges in the link above.

 

You will need to download the claim form from the Financial Ombudsman website.

 

Just complete the spread sheet and claim form and send to the bank with a covering letter asking for your money back :)

Ok, I got the ppi spreadsheet. Do I send a separate letter for other charges/interest/penalties? Is there a template for this? I looked on another website and it said that we have to explain the personal situation in detail. Thank you.

To answer filrobbo - yes, many times. Tried to get a loan out to pay out the overdraft, but they just kept saying not to worry about it, as it's under our limit. What am I supposed to be adding up - PPI charge is the insurance they sold on the account for $12.95 a month (this has been running for 5 years)... And the other charges/interest/etc. - what do I need to do to claim this and can I claim this? Sorry - I just don't know about this enough and need some help!

OK. I need to clarify. When I refer to bank charges I am talking about the interest on my overdraft. There are no specific additional charges such as overdraft set up etc. I intend to outline the financial hardship and irresponsbile lending by the bank and claim back the interest they have applied. Can I do this?

Are you sure that the 12.95 is ppi and not one of these premium accounts. If it is PPI what did it cover, would it apply to the circumstances you suffered ie if it covers redundancy and you/spouse were made redundant then you may get more by claiming on it rather than claiming it was mis-sold
