    • With regards to the letter of rejection, I found a template on line and used that. Please do let me know if anything needs changing.  Thanks
    • Morning, So the finance company is Warrenties2000. I have just sent a copy of the rejection letter to them too. So now they have it as of today, and the Big Motoring World have it as of yesterday. We still have 2 days left out of the first 14 days. The report is not a report, it's an email thread which the mechanic forwarded on to us. it shows that he did send the email to Warranties2000, their reply, and then his reply to them. This is the email that Warrenties2000 have said they've not received. BMW said the diagnostic test usually costs £100 but they have offered to pay £70 of it as a good will gesture. We have told them over the phone that we're not paying any of it. We are 8 miles away from the dealership. We have had 8 days of use of the car and on the 9th day it went to the garage. The garage found the faulty battery and faulty gearbox about half an hour after we dropped the car off.  I've just messaged my husband to tell me who we got the finance from as I don't know. He handled everything with the car.  The extended warranty was £1800 over three years and that was with Nissan I think. My husband contacted the Nissan warranty people yesterday and he said they're raising a complaint on our behalf. I will check with my husband to see if he has cancelled the warranty, I'm sure he has but I will check. So update from yesterday. My husband has cancelled his car insurance as of Friday as the car is undrivable anyway. I'm going to the car today to get our other bits out if the boot.  I have enclosed the details you have all asked for.     • Only had a conversation with the duty manager when I complained.  They were fully booked the night we arrived but offered the room next door for the following night! The hotel is called Widbrook Grange, Bradstock on Avon. I will upload the photos shortly.
    • but there's 'perhaps not entirely forthcoming .. and then theres lying through their teeth - like sunak and farage Vote us in this time and we'll do what we promised to do years ago and not only didn't, but blocked others from doing it .. and did largely the opposite.   I certainly wouldn't bundle a serial killer with someone not paying for a loaf of bread to feed their children eh? I have long voted for those I believe to be least worse - it has been difficult at times - but placing the poops (tory or deform) at the far  backend of my choices currently is not even an effort.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi everyone

 

just trying to sort my debt mess out

 

at the moment to be honest I'm struggling to keep up with things and

seem to think of nothing else every day just trying not to let it crush me.

 

Ok hear goes,

 

had a letter from LLoyds saying they passed my debt on to Marlin Financial Services

( Debt is a current account over draft for £5000

 

this was at the height of my debt problems and

the over draft started at £2000 and I applied online for extra overdraft

and was granted each time until it reached £5000).

 

Then

 

yesterday had a letter from Marlin saying they now had the debt and

I have 5 days to reply to them and fill in a debt planner?

 

There has been nothing paid on the account for 5 years

as every month there was high charges and interest on the account,

 

I went in to the branch and

told them I was struggling to pay this back as the charges were height and I had money problems,

 

I was given the phone and I spoke to someone from LLoyds in India ??

 

And they said they would put all charges and interest on hold for 6 months

and then review thing which I agreed but

 

the following month I got the same charges on the account so

 

went back again and sat with the same woman and she put me on the phone to India again and

 

this time they said that nothing had been put down that an agreement had been made and I must make the payment to the account???

 

This is where i stopped paying and changed accounts.

Sorry it's long winded but trying to give you the full story.

 

I have had a look around other threads and I think I need to send a SAR to LLoyds

but what will I need to send to Marlin I'm a bit confused as this is an overdraft debt?

 

Everyone here are great and all help is grateful and appreciated

Lloyds knew they'd never get you in court for fear of a conter claim

 

so they've sold it marlins for pennies in the pound.

 

you'll get a series of scary letter threatening everything from doorstep no powers raincoat men

to killing your aunts budgie

 

may this if that, never will.

 

i'd get that sar off

 

and prove it is bloated with PENALTY charges

 

then write to marlins and tell them its all penalty charges

that could be used as a counterclaim.

Thanks dx appreciate your time and the reply, will get that sent off. do I need to send Marlin anything? Marlin Europe say they have the debt but sent a letter saying Marlin Financial services are dealing with it I am confused who to send letters to?

sorry also after searching for the TSB address there seems to be a few am I right in using the compliance address in Chatham and do I send a £10 cheque or postal order?

hi mw45uk i am in the same boat i was worried out of my skin,but with the help i have had from dx100uk i now feel in control.i was told not to phone marlin,by members on here so please take that on board be strong and try not to worry.

If you write to marlin I would state you do not acknowledge any debt owing to them and see what they come back with,

Also if you want, send a formal complaint to lloyds bank about the charges they added to your account and how they refused to help you when you were in financial hardship .

thanks oldfletch - staytet appreciate your help and everyone else it helps me with my worry to know help is at hand here, I will not contact them by phone and will send a letter of complaint to Lloyds and see what happens? Do you know if I am best sending a cheque or postal order with my S.A.R letter ?

i sent a postal order you can then see if it has been cashed also send all letters by recorded /regerstered post that way you can track and trace. you also have proof that letter has been sent and i do a few copys with dates ect for my own peace of mind.

I always send a postal order , if you make a complaint to lloyds bank state somewhere in the letter you do not acknowledge any debt

I went through this with lloyds and they sold my account to 1st credit , but once lloyds acknowledge your complaint you can get a formal complaint letter off to marlin asking why they are trying to collect a disputed debt acting against oft guidelines.

It took lloyds and 1st credit that long that when they did come back with statements all it proved was it was statute barred

Ok staytet thanks for that it sounds good to me ill give it a try and see what happens? could I ask if you remember which address you sent the complaint to as I seem to have found quit a few on other forums? I am sending my S.A.R to Compliance Dept.

Thanks oldfletch sent it yesterday recorded think I will need some help if they respond and send my statements back not done the charges thing before so if you have had to do this I would be grateful for any assistance.

sounds familiar, typical indian loyds misleading on the phone and inaccurate records. when your sar comes back, no record of any variation. did you ask for copy of tel calls?

No I didnt wish I had but was not aware I could at the time just thought I had been given some time to sort my financial mess out but it then turns out to have made things worse? I will post as soon as S.A.R comes back I will post. Would be great if you can advise ford if you have been ther?

hi

from reading around, and experience, seems they are not unknown for imparting unreliable/misleading (however it can be described) info over the phone, and sometimes even in person. and their records may be inaccurate.

you could send a ps asking for tel recordings/transcripts. note though that they sometimes conveniently say that they are 'unavailable'/only kept for x mths.

Hi there had another letter today from Marlin threading to advise their client to take further action unless I contact them Urgently within the next 7 days? Should I now send Marlin a letter of some kind? Not had a reply yet from LLoyds regarding SAR but I think they have a few more days yet though?
