    • Hello, After seeing all of the posts about BMW on here I really wish I hadn't even considered them! I bought a used car from them over the weekend, one specifically which had a reversing camera and cruise control in the advert. I was foolish at the time of purchase and didn't check to see these functions work on the test drive (totally my fault). Now that the car is home I've checked and checked and neither of these functions are available. I even checked on Parkers and it seems that no Skoda Kamiq '21 models come with any parking cameras at all. When buying the car, I was told all that was needed was 'Four signatures and £500' to secure it. I was never shown any of the documents, and instead the sales rep opened a box on his iPad and asked me to sign. He had been complaining about the length of time some customers take these days all throughout my time with him. (Again) foolishly I signed. In my email inbox I now have four attachments from BMW, one of which is my signature under a letter which basically says that the cars don't need to match the advertisements online, or have any of the features that a sales rep talks about. I realise that I've made mistakes in not doing my due diligence here, but thought I might as well ask the experts here if I have any rights left to claim that the car was miss-advertised, or if I unknowingly signed them away? Thanks in advance

    • ah this is a B2B PCP then as your are sending the SAR as a private individual and not as repping the co. you need to prove to them. unfortunately, i think that will also reset the 30 days. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Right, we are with BG for both gas and electric and they will not let us change suppliers as we are in arrears with them mainly due to me losing my job 2 years ago, we did try to change to Co-op but BG stopped it and said no, Co=op were informed and we left it at that but we have been getting bills for gas for co-op even thought we are with BG. When the first one arrived we wrote back and explained we were with BG and not them, it went quiet but then they stated up again, once again we wrote back to them and this time they said we had signed up with them for both gas and electric, we told them BG would not let us swap and we heard no more till once again today we have got an estimated gas bill from the Co-op once again, I have emailed them this time to ask why but no reply and also told them to contact BG for confirmation, we can not have 2 gas bills! Nor can we pay what they say we owe them, plus no one has been to read our meter, BG email us to get a reading.

Sorry for long post, really confused

no conniff, nothing all we were going to do were change to co-op but BG stopped it and we heard no more

a normal on conniff, we owe quite a bit to BG for gas and electric and currently pay £15 every two weeks for both will have a look for exact amount

right, we owe £236.36 on gas and £133.09 on electric, £15 on both will be paid today ( £ 30 in total ) we only have a gas cooker and gas c/h, electric is lights, tv etc

If it is a prepayment meter then you can have a debt of up to £500 and still change. If it is a quarterly bill meter then they can insist you stay with them until the arrears are cleared.

 

I think they only insist on you staying because they have the threat of them breaking into your house and disconnecting the supply should you not pay.

 

You should send a letter by recorded delivery to the Coop and again reiterate that you are with BG and have arrears and they will not let you change supplier until those arrears

are cleared so you could not have signed a contract with the Coop. Say this is you final communication on the matter.

thanks conniff we will, we do not have a prepayment meter. I sent Co-op an email and if no reply will once again write to them, the bill they sent today is for £427.84! thanks for the advice
