    • S.88 only applies for the UK, incidentally. If your licence has expired and you meet the conditions for S.88 you can drive in the U.K., but not outside the U.K. 
    • Sleep apnoea: used to require the condition  to be “completely” controlled Sometime before June 2013 DVLA changed it to "adequately" controlled. I have to disagree with MitM regarding the effect of informing DVLA and S.88 A diagnosis of sleep apnoea doesn't mean a licence wont be granted, and, indeed, here it was. However, the fact the licence was then later granted can be used to be persuasive that the driver’s belief they met the standard was correct.   What was the other condition? And, just to confirm, at no point did DVLA say the licence was revoked / application refused? I’d be asking DVLA Drivers’ Medical Group why they believe S.88 doesn’t apply.

    • think about it, if you don't pay the full amount, what more can they do , default you  they've already registered a default notice by that point.  why have you got to await sale to a DCA.... for what?  
    • I see what you mean. In terms of resuming payments does it matter the amount?  I read that they eventually sell these on eventually anyhow ? But I guess based on what you are saying this is years in the making and I may as well wait for one to be sold on?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

Im having a real struggle with the sale of a leasehold masionette I own.

 

So I originally purchased at the value of £175k as a leasehold. As it was my first ever purchase I wasnt exactly "street wise" when it came to the buying.

 

The leasehold currently has 71 years to run but at the time of purchase I was not informed that anything under 80 years would have serious issues when it came to either extending the lease or selling the property. Neither my financial advisor, estate agent or solicitor mentioned the potential costs (being quoted £13k to extend by 90 years!) and this has obviously come back to bite in a big way. Ive checked all the documents and not anywhere does it highlight its an issue through either solicitor of FA.

 

Probbaly a little late in the day now but do I somehow have a case? If I do how and where do I pursue?

Really feel like all three parties saw me coming, I had a big pot of inheitence to lay down but now the money from my fathers death is going to be wasted on paying an extension of a poxy leasehold!

 

Any advice would be greatly appreciated

If you paid for a full survey, the surveyor should certainly have highlighted this in his report and imo you would have a case against him and also possibly your conveyancing solicitor. How recently did you purchase the property? if in the last few years I am suprised if you managed to obtain a mortgage without this being raised

In view of when the property was purchased, and the fact that the survey noted the lease term, imo your complaint would be against your conveyancing solicitor, who should surely have picked up on and warned you about this issue. At your solicitors practice there will be a designated complaints handler to who you should send your initial complaint. The Legal Ombudsman website has much more info on how to go about and progress your complaint, and also an excellent complaint template letter that you could adapt and use in the first instance
