My daughter had a card with Dorothy Perkins which was run by Santander.

 

In 2011 she tried to re-mortgage only to be told she had a bad credit rating.

 

She checked Experian and saw a charge from Santander.

She did not recognise this and phoned them and was told that it was for a Dorothy Perkins card.

 

She then spoke to another company who we think were the Lewis Group.

 

This was on the 6th October 2011 and she told them, rightly or wrongly, that she would pay it straight away to try and clear her credit history.

 

She then paid the money to a firm of solicitors called Howard Cohen who confirmed on the 6th that the money had been received

and then sent a cheque to the court and got a Certificate of Cancellation.

 

However when we checked her Experian account it still shows:

Current Balance.............Satisfied

Default Date....................21/07/11

Satisfaction Date.............18/10/11

 

She moved house in 2008 and had her mail redirected for a year and in that time received nothing from either Dorothy Perkins or Santander.

 

So prior to this going to court she knew nothing about it.

 

In fact if she had not tried to re-mortgage she would still not be aware.

 

We have been trying to get Santander to remove this from her file

but were told that as she did not pay the minimum as required under her Credit Agreement £12.00 late charges were applied to her account.

 

I have asked Santander for details of how the money we paid was made up.

 

I have a suspicion that most of it was late charges.

 

I know we should have queried the whole thing before paying up

but decided the remortaging was more important and as it happened, and is still happening, the mortgage was refused.

 

Does anyone have any suggestions about where we go from here.

if she knew nowt about the claim form nor the CCJ?

 

she should apply to get it set aside.

 

'paying' a debt, does not remove the default, nor the CCJ

 

just marks it as satisfied. but the default will remain in the history.

 

i'd get a copy of the CCJ from the court first.

 

seems like you might have heeps of PENALTY charges to reclaim too.

 

get an sar off to satans bank as well

 

get all the statements.

Many thanks for that. Just spoke with the court and a copy of the CCJ is on its way. They did tell me that the address might have changed to her current address because she applied for a certificate of cancellation but we will have to wait and see.

Any clues where I find a draft letter for a SAR.

I am still waiting to receive the SAR from Santander but

 

in the meantime I have managed to obtain a copy of the transactions from January 2009 till the account went to default in July 2011.

 

It shows:

Purchases £263. Interest £89. PPI £56. Late payment charges of £180 and payments of £356.

 

There were several times where no payments were made .

 

Can I claim these charges back along with the PPI

or will the fact that some months no payments were made make a difference.

Just received a 3 page final response letter telling me why they have not upheld my claim.

usual reasons,

you signed for it,

you had 30 days to cancel etc.

 

The form was filled in instore and has crosses against all the places to sign including the PPI.

I said in my claim that I did not need the PPI nor want it.

 

A default was placed on this account but when I re-calculated, ignoring the PPI, it never was in default.

There was also some late payment charges of £15.

 

I don't know where to go from here.

scan up the fob off letter

 

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

Yes afraid so. Santander have refused the claim. They also refuse to answer any points I have raised just keep sending the same standard letter saying they have given me a full and final response so I thought I might try Genworth rather than FLA but I am not too sure what I need to send them.

Ah ok thanks. As it was before 2005 then fos probably won't take it on. No harm in calling them to ask though. You might be lucky and they will take the case to Genworth for you.

 

If not, all you need to send to Genworth would be the same paperwork/letters etc. you submitted to Santander.

fos is the Ombudsman service, they are the same thing. As I said you will lose nothing by giving them a call and asking if they will take it on but I am not hopeful.

 

If you make your approach to Genworth, send them copies of everything you sent to Santander with a covering letter explaining why you are now seeking redress from them.
