Hi,

 

I have read through the other Egg/Barclaycard threads and did not know whether to jump in on another or make my own.

 

Last thing I want to do is hijack someone else's thread, although there are some great stories here.

 

So hopefully someone can give me some help.

 

I have recently sent a CCA letter from the templates section on the site to Barclaycard who are hounding me for payment on a credit card.

 

Original account was with Egg in 2009, which was then taken over by Barclaycard. I have had Barclaycard and Mercers hassling me and with a massive change in income cannot pay.

 

I sent the CCA to see if there was a signed agreement in place. I attach two pages of the letter back from them. Plus page one of a 'standard' agreement copy they just sent through.

 

They say they don't have to have an agreement signed, I don't know what to do next.

 

If I throw up the files here, I have taken out all references, but any help would be gratefully appreciated.

Can't read the attachments, but they can produce a reconstituted agreement, which does not need signatures, but must have your name and address at the inception of the agreement, the same for the creditor and ALL the Ts & Cs from inception to closure and any amendments.

 

A judge may decide that if there is evidence of usage of the account and payments made to it that the debt is enforceable.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

you need to PDF the attachments

 

dx

 

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

BUT......

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all monetary figures and dates.

DO IT IN MSPAINT.EXE or any photo editing program

if you have multiple scans/pics

put them in a word doc FIRST and convert that to PDF

or use www.pdfmerge.com

 

convert existing PC files to PDF [office has an installable print to PDF option]

..

 

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

.

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

though dont use full bank names or CAG in the title

i'e Default notice dd-mm-yyyy TSB

.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I uploaded 800px x 1100px jpegs so I don't know what went wrong on the downsizing, the attachments look tiny.

 

So I am going to try again ;o)

 

Just tried again, and the system converts each 300k file into something like 8k tiny file size...weird?

I'm not sure we even need to see the documents - they'll be the same as we've seen many times before.

 

Because the a/c was opened after 2007, the bank can respond to your CCA request with a reconstructed credit agreement but they should also supply all the altered T&C's like is said above.

 

Can you confirm roughly what is owed at the moment.

 

Do you have the a/c statements handy. If so, you should check for penalty charges and/or PPI that you can reclaim to reduce the a/c balance.

 

If you don't have the statements handy, send off for them using a SAR.

Hi Slick,

 

I have finally converted to PDF and uploaded.

 

There is just under £11K on the balance, currently adding £250 a month in interest. I used the card when I had a business to basically keep it afloat, but I really should have folded, I got taken to the cleaners by a couple of clients.

 

The business folded, my income has gone down to zero and I have no way of paying back.

 

I have not used the card for nearly two years since the business went, I have tried to pay something, even sent them an income and expenditure on what I have to live on and they were'nt interested.

 

I recently sent them a letter regarding how I feel I have been handled, they sent one back saying they are looking into this and will respond by 17th Sept, still nothing.

 

But strangely I had a letter at the tail end of Aug saying they had found that they had made an interest calculation error. It was based on a reduced repayment plan which included a lower interest rate, unfortunately the rate was calculated incorrectly, which means I was charged too much interest.

 

They over calculated £540, which has now been credited back to the account.

 

I am still trying to scrape together freelance work to live, although I have had letters from Mercers, this is still with Barclaycard.

 

Would £20 a month be thrown back, to be honest it is all I can afford. But can I get interest frozen?, this is what I original tried to do by letter over a year ago, so they came back with a reduced interest, but that seems to have now gone back to 26.9% after their cock-up!

 

A full and final would be thousands, not that I have anything, but someone I know 'may' be able to help.

Hi SW,

 

BC should have either reduced or stopped adding interest as soon as either :-

 

1. They became aware of your Financial Difficulties.

 

2. You told them of your FD's.

This may be why the made the refund to your a/c, to reflect a reduced interest rate being applied to your a/c.

 

Even if they are charging you a lower rate of interest, ask them to reduce this to zero and send them your I&E Spreadsheet to show how much you can afford to pay.
