      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I don't. He may have had some recent ideas i could agree with over the last few weeks, but definitley not his outbursts over the years.

 

The main issue i have with him is that he is very racist and very sexist. He subscribes to the turn of the 20th century way of thinking. Ideas that are not relevant at all in todays society.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Not sure about his early stuff but the Bongo Bongo issue, well wasn't he using that term to describe the bonkers situation where silly money is often sent to foreign parts where no accountability is involved..

Again, the use of bongo bongo land, wasnt referring to the situation. But was a racist name for the country, that has been used decades ago. Read the entire quote again. It is pretty clear. He MIGHT have some good ideas, but he ruins them by adding in his pointless and stupid racist comments every single time.

I saw nothing in the transcript that was saying to me that the use of the term Bongo Bongo land in the context that it was used was racist. There was no mention of a persons skin colour (as I could see) and was to my way of thinking is some peoples attempt to suppress free speech..

I dont know if hes racist or not. Iv heard the speech and the words bongo bongo didnt seem to refer to one race or country. However I do see how some people could see this was a racist comment although my black spouse nearly fell off the chair laughing. We did however agree with some of what he said. There are a lot of people in this world who need aid, however our governments should be putting pressure on these countries to help their own. Clearly if countries can afford jets and a space and nuclear programme they have enough money to raise the living standards of its people. Put it this way, after the New Orleans disaster it was clear that a lot of the people were living in terrible poverty and the the authorities didnt actually rush to help. We wouldnt give aid to USA would we.

I'd fully agree to that. The main problem is that successive UK governments have tried to put on a powerful face around the world when they give financial aid. The problem however is the aid is given to that countries government. Not handed directly to where it is needed. Those governments then siphon off the money until theres pretty much nothing left. Central Africa proves that 100%.

Cant do that CD, due to various laws on imports/exports/purchases etc etc. It is completely retarded, but the law is the law. What the government should do is allocate the money to international charities who actually work in the problem areas, so the money is guaranteed to go into hardware and staff to help those in need. If you put the money directly to the governments first, then NOTHING will ever happen. Zimbabwe/Ethiopia for example.
