    • I have just read the smaller print on their signs. It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

well they never phoned so i phoned them apparently area manager has her day off plus she.s been in meetings in other stores got to wait until tomorrow. can i make them pay me by instant bank transfer instead of cheques if they do cough up they don.t accept cheques why should i .

Why are you telephoning them ?

 

You need to write - lay out your complaint so they cant misunderstand what you are requiring. You give them a date say 14 days from the date of letter by which you want a satisfactory response.

 

Do you have all the details of your claim - if not, then perhaps you should send a SAR in order to obtain all the necessary information.

 

If your claim is successful, you can say that you want a bank transfer if that is the way you want to be repaid.

i phoned cause they where suppose to phone me today to tell me the out come of mis selling the insurance

 

when i phoned them about it she said the manager would investigate and get back to me within 48 hours with her findings.

 

they wanted to see if i had been mis sold it but one of the other supervisor already stated that i shouldn.t of had it has i had insurance .

 

i didn.t point out it was her who done it when i first ever joined them.

 

they started to be really nice to me when i asked for the insurance money back see.

 

trying to get me to re write my items and to stay with them

 

told her straight i want to get rid of everything as soon as i have the money

 

you can have your items back its cheaper for me to go out and buy news one.

 

if no go tomorrow i will be sending letters and also contacting financial ombudsman they.ve messed me around enough now.

right bh just got back to me and said cause i didn.t have dlc on all my items i mostly had osc

that i can only have about 700 and can.t get the osc as i.ve claimed on them when i had a rewrite 2 years ago and i don.t even know why they did that

 

it was when i just had a baby and we had that really bad snow and couldn.t get there to make some payments

so even though i paid late and charges they wanted to save me a wks payment by rewriting it

 

what i never knew was you lose your rights also i have call outs for some repairs and that was within a few months of having them .

 

my settee is crap zips keep breaking and they.ve been fixed and broken again.

 

my tumble drier broke within days of having it needed a new bottle waited 4 months for it

 

waited over 4 months nith times for settee to be fixed.

 

they said i.d used up all my service cover.

 

can i claim the osc or not cause with that

 

i.m owed 4500 not 700 or are they pulling a fast one .

is there anyone i can phone and discuss this with who knows what they are talking about cause no why have i used 4500 of service with them .they never even fixed my washing machine in the end i had to geta new one they kept telling me to reset it to work tidy but it didn.t always work i.m desparate need this money bad.

phoned FO and they said they can.t do nothing about the osc as its a service not insurance so they don.t cover them and to go to citizen advice and also contact the malta financial oms to complain cause its to do with them.

STOP phoning.

 

Put your complaint in writing and send it to their head office recorded delivery. If you don't have a computer go to the library but you must put this in writing for them to take you seriously. I'm confident that their offer will go up once it's on paper.

 

The repairs would have been covered under the SOGA so you can try and push with that regarding repairs.

 

Once it's on paper they will act because they cannot lie their way out of it. If you keep phoning they will just keep fobbing you off. Stop phoning, start writing.

one other thing

 

if i didn.t have either of the covers with them and my item broke in the first year in my case a few weeks who would i have gone to , to have it fixed.

 

they told me if i never had the osc i would of had to go to the manafacture to have fixed not them.

 

i know this is wrong cause i also got items with bayv and no insurance took it out separatly as they never pushed it on me like bh.

 

well when my fridge broke and broke i.d phone them and they would arrange for it to be fixed as first year is free

 

they said and have been great as believe me i.ve had them out so many times.

 

so ard they just fobbing me off want to get it all ritten down the lies they.ve told me.

hi going through my contacts and have found that bh haven.t signed my copys at all also got one that i never done my signatures on the back all the way down don.t know about their copys but are they binding as i.ve paid these off and they got the osc cover on them.

hi i.ve other threads on here as trying to claim the insurance back so going through the contracts have found 2 mybe 3 as can.t find one contract yet and was taken out same time they never signed my one so is it still legal i.ve paid these off but was missold the osc on them .i.ve also got 2 wihout my intials on the back of contract what does this mean for these few contracts. i.ve phoned and i know you not suppose to but needed to know where i stood and they not got a clue . also just realised that the ones they never signed and one of the ones u never was rewritten when i had 30 wks left even though i wasn.t in arrears with them.

i.m trying to write my letter out for my claim should i offer them a deal as 4 contracts not signed two by them and two by me .also if they take me to court i still will not give my permission to take my items and then they got to pay me every penny i.ve paid for them so in it a win win case as i.ve got about 4 grand or more owed for items. what does anyone think about this.

the unsigned contracts makes no diff to the reclaim

 

simply put in two spreadsheets [ or more ... one for each ins on each loan]

 

and a letter that says you want it back

 

use the foscisheet for every spready

just for anyone to know any credit agreement has got to be signed by both partys don.t know yet what it means if one don.t ,wheather you can claim all money paid, got to speak with cab again but the more amo i get against bh the better has they are digging their heals in about osc.

hi

 

had a call back from bh said they got a cheque there for me but still not sent it, this is for dlc .

 

but as i used my osc they won.t pay that back

 

told them i was entitled to have my items fixed without this under soga .

 

i high litghted that i was never asked if i wanted it and its put in my contract automaticaly when i did ask not to have it

 

they wouldn.t take it off said its best to have it even though i had insurance for breakdown.

 

what response should i give now

 

she.s looking into it further and i told her that i will take it to a small claims court if i got to and will not pay arreara until this is settled.

brighthouse getting bad publicity in wales on the ferret .

 

decided that i.d email them as getting know where with them dragging their feet

 

see that i will let them know again

 

they get until tomorrow to respond to me if not i.m contacting whatchdog which i already did tonight,

 

also xray and the ferret .

 

they won.t release my cheque for dlc either cause they looking into the osc as i.ve used this service.

 

i.ve also had my final default notice got until 26/12/12 to pay arrears

guess what they still got the dlc and osc added onto them only showing one lot of late payments

but i know they want everyweek i missed. told them i.m not paying as want my osc back and

 

u can take me to court and i.ll never give my items up so will get all money back i paid on my items which is over 3 grand

then will take u to small claims court for the insurance.

advice needed

 

just spoke to bh and they.ve finished their investergation and won.t be paying my osc back

cause they reckon i.ve not been miss sold it

 

i signed it and have used the service cover aswell.

 

first i was never asked if i wanted it

 

i was entitled to have my goods repaired under soga .

 

what do i do now is it worth small claims court over 3500 owed back.

like PPI it matters NOT that you've used it.

all you do is make up the spready and deudct the usage figure from the total.

 

they HAVE refunded OSC several times on here.

how do i work out the usage figure and haven.t a clue how to do the spready

 

the thing is they are sending it a letter out detailing why they have refused me

 

i.ve told them then that i will take it to small claims court.

 

also they want me to rewrite my items as i.ve been given until the 28/12/12 to pay my arrerars .

 

told them no way and u can take me to court that way i can get my money back for my worthless settee

as its got to be made out of the cheapest materials ever.

 

what do u think i should do.
