      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good evening,

Any help with the following would be much appreciated as seem to have hit a brick wall ;-((

 

My partner had/has 10 separate loans for 10 separate vehicles which he didn't realise he was paying PPI on each individual one.

 

We have followed all the correct procedures to reclaim and have received by registered post a big wad of all the agreements all signed by my

partner and basically presenting their findings in which they state

-Lease Purchase Agreements and Terms

-Insurance Premium Agreements

-Demands and Needs Statements

-Keyman Cover Summary documents

saying we have signed to confirm acceptance

 

.......

"as a result of my investigation, I am sorry that I am unable to uphold your complaint. I feel it is clear from the documentary evidence provided were aware that cover was to be applied to the agreement"

 

and goes on further to say about going to the FOS if not satisfied etc etc

 

My partner remembers being told that he would not get the loans unless he took out the agreements and that as soon as everything was agreed they would be removed so he pretty much had his hands tied ;(( but how on earth can I prove it?????

 

Please any suggestions would be more than welcome.

If you disagree with them, you can respond to each point rebutting it. Give them one last chance to reverse their decision. But don't give them too much time as it will eat into the 6 months that you have in which to go to the Ombudsman.

 

If they had implied that you would not obtain the loan without the PPI, then that was not permitted.

Thanks guys, kind of thought this but wasn't sure how to go ahead. So in short you say go back to them disputing each point? Before FOS? Do you know if there are any template/correct format letters I should be writing.

Hi again,

 

It has now been 7days past the 14 days I gave Lombard to respond to my letter and still nothing, i thought i'd wait a little longer because of bank holiday etc ;-(

I stated that I would go to the ombudsman if they did not comply so would you advise making a call to them(Lombard) first? to make sure they received

the letter as stupidly I did not send it registered post.

Or just go straight to the ombudsman??

Ok,

Not good news:( Lombard will not uphold our complaint and they are confident that the insurance cover was not mis-represented.

They have said we can refer our complaint to the FLA if we are still unhappy!!

 

They have thoroughly looked into our case and I am shocked they have come to this decision, I realise that we signed for the cover however

the mis-representation was the fact that we were told that we wouldn't get the loan for the amount of vehicles we required without it and

that it would better our chances.....and then it would be removed once all the loans had gone through.

 

Has anyone else had this problem or got this far ??

Advice desperately needed.

Please help.....

 

I have follwed all the correct procedure and nothing.

 

I went to the FOS as totally mis sold PPI and not only did they send me a letter today which was the wrong letter they have

also said that LOmbard North Central Plc are not under their jurisdiction and there's nothing they can do...............

 

Does anybody have any further advice as I feel totally cheated.After speaking to FOS I did not feel any better as the girl on the phone was

of little help and kept putting me on hold to make sure she had said the right thing ;-((
