      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, Have you tried Paul Mckenna s gastric Band Book or his I Can make you Thin? There around 400+ of us on it all ages and weights. There are several guys on it too with alot of weight to loose, and its working for them. No fady diets to follow just common sense. We are on facebook but you have to register to join which is free at the moment.

Why do you feel you need to lose weight? 12.5 stone is healthy. Whoever told you that you need a diet needs to see a psychiatrist.

I agree with the people who say you don't need fancy diet plans or to pay money.

 

There's masses of information on the interweb, you can find an exercise regime that would suit you and research calorie intakes and calorie values of different foods. One of the most important things in my view is to eat less fat, and of course saturated fats are seen as not very healthy.

 

If you really want to lose weight or change shape, there is information to be had and you can probably find a forum of like-minded people wanting to lose weight or become healthier and more toned.

Hi, how is your weight loss going?

I was wondering if you still need help or if I could give you some information.

I wonder you still eat meat, cheese and egg. If so how much per a day.

I basically want to know what your typical diet through out the day and current health issues, activities.

 

I'm trying to help people to have a good health and help meet their goal.

I wouldn't go that far. It could very well be that he genuinely perceives himself as overweight, which is his right. He may very well be incorrect but we don't know how this 12.5 stone sits on his frame. He could have a very small frame despite his height and it could fill him out rather well, or it could all be in his stomach and no where else, which gives you that undesirable "gut" appearance...

 

It doesn't sound like he (after all these months, though) wants to starve himself or drastically change anything... Seems like he just wants to eat and exercise in a much healthier way which is something admirable even if his weight is fine. You could weigh a reasonable amount but still be unhealthy!

 

I echo the sentiment that you should keep up your steady diet (see if you can incorporate more fruits or raw veggies throughout the day!) and if you need a gym, to get into a gym. There are many, many resources online to exercise for free without equipment, though, so that is an option... Pinterest is often boasted as a hoarding site for females but it's a great place to find fitness sheets and exercise directions, as well as recipes for healthy meals. Men and women alike, I think. I'm on it, so I hope it's for men, too...

Easiest way to get in shape, is watch your food intake, use portion control, and do a decent amount of walking, running, swimming or cycling. All 4 are great cardio workouts which give an overall body tone, and help your metabolism to burn fat faster.
