Good morning!

I am new to this forum, so please have patience with me. I urgently require help re:1st Stop Payday Loan.

They have issued court papers, that I have received yesterday 23/02/13. Papers are dated as 20/02/13.

I have borrowed £200 from them on 29/08/12, however on their paperwork it says that I have borrowed £346.74. That is not correct.

My financial situation has changed drastically, going through divorce, paying mortgage and secured loan etc...

I have made following payments to them - £40.00 ; £25 ; £25 ; £1 In total £96. I am willing to pay £145, which represents original amount and one month interest minus payments already made.

I need help with acknowledging and filling in court papers. I am sick with the worry, as i don't want to get CCJ.

Please help.

Hi aronik and welcome to CAG

 

Your summons is dated 20/02/13 so you have 33 days in total subject to your response(5 deemed served so 28 ...14 to Acknowledge Service and if defending another 14 days to submit your defence.

Hi Andy! Thank you for your reply.

I have another question, I am affraid.

If I acknowledge court papers today, would I have 14 days to partial defend as of today or would it still be 33 days from the issue. I hope this makes sense.

 

Has anyone had any experience with them? What are the chances that they will accept my partial admittance and agree to my proposed payment?

All help is greatly appreciated! Thank you!

You can AoS anytime but no later than 08/03/13 (Friday)

 

To clarify If the defendant admits part of the claim and the Claimant accepts the part admission in settlement they can request judgment for that amount plus the recalculation of interest and costs allowed for that sum. If the Claimant rejects the part admission then the court will treat the matter as a defended matter and the claim will be transferred for future conduct.
