    • You did what??? You asked them to send you the documents that without them you had  a 100% ironclad win in Court. Why on earth would you do that? As it happens in this case, there is still enough mistakes in their PCNs and the NTH to have your case cancelled. Amd it may be that not sending those documents in the first place along with the ICO complaint and the letters from Alliance themselves which would confirm by the dates on the letters may be enough to cancel it anyway. I hope you have kept their letters as evidence? The chances are that Alliance will not actually take you to Court because of their errors but you never know.  You have made so much extra work for yourself in your WS if they decide to push their luck.though. Can you please post up their letter where they give the reason why I wasn't sent with the NTH.
    • I'm not sure that I fully agree with my site team colleague above.  My understanding is that there is nothing to stop you recording but it is strictly for your own personal use.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Check the T & Cs as some require it. We tried to get an insurance for a vehicle that was to be SORN'ed and no one would touch it except for third party. However I am fairly sure that where ever it is, their insurance should cover any mishaps. I would go and find the vehicle as it has been known for them to leave windows wide open on stored vehicles.

Kwik Fit are the biggest cowboys in the business, they have no respect for anyone else's property.

 

I have a 12 plate Citroen DS3, the car is my pride and joy.

 

I took my car into KF to have a puncture repaired, upon jacking the car up, they managed to dent the sills near the jacking points causing the front of the sills to bulge which in turn caught the front nearside door when opening and closing.

 

They also managed to drop the alloy on the floor while the tyre was removed putting a nice dent on the rim of the alloy, which in turn meant the tyre could not be refitted as it was a danger, and to make matters worse I had no spare only an emergency repair and inflation kit, meaning the car had to remain there until they ordered a new alloy.

 

To be fair they got the damaged fixed at their cost in a bodyshop but nether less their failure to care for my vehicle is beyond belief.

 

I shall never use KF again.

It's also out of warranty oddjob and even if there was an extended warranty which is very limited anyway given the ageof the car, the chances of failure are very remote with this engine.

 

If it is a AD diesel engine then there is a known issue with head gasket failure. There is a Toyota entended warranty covering this engine for 7 years and 111,846 miles. However looking at the document (AD Engine out of warranty guidelines (0730J)) this may only be applicable to an older RAV4s and not the OPs one. The production dates covered are Jul 2005 to Dec 2008, so being an 09 model it maybe a petrol vehicle and the above will be void. OP what engine does your RAV4 have (or had as the case maybe)?

Hi everybody and apologies for being so late with this update.

 

As mentioned in my previous posts, I rejected their initial offers as I found them unacceptable. Later they agreed that their offers were not good enough and even they wouldn't accept it. LOL

 

After that, their insurance company got involved, they passed the matter to a company called Northern Assessors to evaluate the damage. Then they passed the matter to Loss Adjuster who approached me with two new offers:

1. They would buy a new Short Engine (lower part) from Toyota and let Motorman do the job. Also, all damaged parts (if they'd find one) would be replaced.

They offered 1 year warranty on a Motorman workmanship and 2 years warranty on Short Engine from Toyota.

2. They'd write off the car and pay me £13,600.

 

I opted for the second option because I no longer trust that engine as it's been disassembled and then reassembled at least 4 times by now, besides, when they said to me that "they'd also replace all damaged bits and pieces" that "bits and pieces" completely put me off this vehicle. I am not an engineer and I wouldn't know what they fit in the engine. I couldn't trust KF ever again.

I'd rather take the money and buy a new "used car" with a factory built original engine in it and with full service history.

 

Anyway, this case is closed now :)

By the way, they have compensated all loses incurred during this dispute (insurance, residents permit, etc). In addition they agreed to let me keep the courtesy car for another 14 days that would enable me to visit places to buy a new car.

Seems like a reasonable outcome. Finding another one in equally good condition will be a challenge.

I know, but keeping that car I found was too risky. Way too many parts were damaged and it would be like getting a 10 years old car with no service history. ))

 

I was thinking, maybe I'd go for Nissan Qashqai as it's cheaper, then again since I'm not an engineer I wouldn't be able to check the car.

The safest way is to buy from an official dealership.. but I don't have money to buy a brand new car ((

I was thinking, maybe I'd go for Nissan Qashqai as it's cheaper, then again since I'm not an engineer I wouldn't be able to check the car.

I would definitely go for another Toyota without a doubt. :lol:

I mean, my favourite is Toyota but it's more expensive, that's the problem...but, just out of curiosity, why not Nissan Qashqai though, is it that bad?
