    • Have we seen your court bundle?   If we haven't then it's probably an idea to post it up here especially the index page and the witness statement so we can see if there is anything which might need adding or changing 
    • "Care to briefly tell someone who isn't tech savvy - i.e. me! - how you did this?" Its pretty simple although not obvious. You open the google maps app > click your profile picture > Click Timeline from the list > click today > choose the date you want to see the timeline from. Then you'll see your timeline for that day. Often, places you have visited will have a question mark beside them where google wants you confirm you have actually visited. You either click 'yes' if you have, or you click 'edit' to enter the actual place you visited. Sometimes, you'll see 'Missing visit' This probably happens if your internet connection has dropped out at that time. You simply click 'Add visit' and enter the place. The internet on my crappy phone often loses connection so I have to do that alot.   OK dx, understood mate. 
    • I have now been given a court date vs Evri, 4th Sept 2024. I have completed my court bundle, when am I expected to send copies to the court and Evri and should it be in hard copy or electronic? The Notice of Allocation states that no later than 7 days before the directions hearing both parties must send to the other party their final offers to settle. Does this mean I will have to tell Evri what I'm willing to settle? Rgds, J
    • Ok how about this to the CEO? I know it sounds super desperate but lets call a spade a spade here, I am super desperate: Dear Sir, On 29th November 2023 I took out a loan of £5000 with you. Unfortunately very early into 2024 I found myself in financial difficulty (unexpected bills and two episodes of sickness and the tax office getting my tax code wrong resulting in less pay for two months) and I contacted you (MCB) on 13th February 2024 asking if there was any way I could extend the length of my loan to 36 months. I fully explained why I was requesting this and asked for your help. I did not receive a reply to that email so I again contacted you on 7th March 2024 to advise you of a change in my circumstances which resulted in me having to take out a DMP and asking you to confirm that the direct debit had been cancelled. You would have also received confirmation of this DMP from StepChange but you did not acknowledge receipt of my email. I have only managed to make one payment from my loan but did try and contact MCB to discuss extending my loan, help etc.  I have now therefore fallen behind on several of my debts, yours included, and as a result you have lodged a Cifas marker against my name for "evasion of payment", which has resulted in me having to change banks, which has been an extremely difficult process because of the Cifas marker. I do not feel you have been fair or given me the opportunity to fully explain my situation to you before you lodged the marker against my name. I appreciate it is a business and you have acted accordingly, but I did try to make contact to arrange alternative arrangements and at no point, not even to this day, did I ever intend to not repay my loan. I cannot stress to you enough how much this has affected my mental health. I am having trouble sleeping and my existing health condition has been exacerbated by all of this. What I would like you to do is to please, please remove the Cifas marker and let me make arrangements to pay the loan back through a DMP.  Please sir, I am begging for your help here. I am not a dishonest person and I have never been in a situation like this before. I am desperately trying to make things right but this marker is killing me. Please can you help me?       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well here goes

 

I took out a re-mortgage back in 2003 and PPI was added along with a life insurance policy also a month later in 2004

 

I had a top up loan with the same company we did this on thier advice which was have a smaller re-mortgage and then add the top up straight away as this would be easier to approve ?

 

this was obviously for them to increase thier fees and profits as they added another PPI policy to the top up

 

not long afer we reapid the both loans in full and I forgot all about the policys, untill the other day when

 

I came across the paper work again and realised id been fleeced.

 

I used one of the templates from the site to request a refund and today got the reply That the policy was taken out over 6 years ago

so was statute barred also it was before the date that the FOS was involved

so they would be unlikely to help,

 

any ideas would be appreciated

Forgot to say in thier reply they gave me the underwriters details for CIGNA but the address they gave was for Belgium,

 

I had spoken to cigna before contacting the money group and they were extremely helpfull

gave me all the details and refrence numbers

but the office i contacted was in england not belgium

 

is this a delay tactic by the money group ?

Could you please convert your document to a pdf - follow instructions below - as it is a wee bit tiny at the moment :)

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or ir you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

I have the original documents relating to the loans and insurances which is where i got the figures from but my calculations for the intrest may be out, not 100% if i used the correct formula.

and fact that the FOS clearly state that if the complainant has all the documents [and you have]

 

they should not

simply look for EXCUSES

tell her you have fwded her letter to the FSA awaitng a reply too.

 

have you all the statements

dx100uk thank you for your reply, I will do as you have suggested,

 

I dont have all the statements and i have not SAR them,

but i have the documents from the mortgage I took out after them showing the payments made to clear both loans,

these also proove that no reimbursement was made of any of the premiums.

 

Can you tell me where I can get a copy of the FSA statement to refer them to it please,

or any other legislation that prooves they are acting against the FSA and the FOS.

this is the reply i recieved from her today,

she only included the documets for the one insurance and not the life cover or the other ppi

and it shows clearly the cover only lasts for part of the life of the loan and I think it only applied to the loans taken out at the same time

which means it would not pay out after the loan was repaid.

 

and the sales rep definately told us they would not give us the loan without the insurances

despite what thier documents say, maybe they would have but we were told different.

 

They dont seem to be willing to change thier stance and I wonder how many they have managed to put off claiming thier insurance back.

Any help with the next step would be appreciated

IMO I believe you should not mess about with these people as they will keep fobbing you off and giving legal argument to your claim for mis sold PPI. I would gather all your information to date, all of your consumer gredit agreements, letters and any other information you have in relation to your complaint of mis selling PPI. Lodge a case with the FOS.

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Remember a complaint to the FOS will automatically result in a fee to Money group of £850 to take on the case you may like to inform them of the action you intend to take.

 

The £850 figure comes from IMS21 it used to be £500 when I was last involved with CAG.

Getting things together for theFOS complaint but would love to send a good reply to that last letter i recieved, but struggling with the legal arguments .

I am rather concerned that for someone with LLB Hons & 8yrs of responsibility over handling PPI complaints & p'haps a even a team, mis quotes the statute of limitation

and in deed the advise contained on the FOS and FSA websites concernig PPI.

In relation to PPI,

the correct is 32b

Section 32(1)(b) of the 1980 Limitation Act postpones the commencement of the limitation period where

in case of fraud, concealment or mistake.

 

In such cases,

“the period of limitation shall not begin to run until the claimant has discovered the fraud, concealment or mistake or could with reasonable diligence have discovered it.”

the rest of the letter is pure speculation that the correct process did take place.

she was NOT THERE IN THE ROOM

when the advisor told you you had to have it.
