I am my wits end now.

 

I sent off letter 1 in July, asking for all my statements.

 

The Abby replied, advising the microfiche argument.

 

They sent 12 months worth of statements.

 

Advised they would use the 10pounds for the microfiche search

 

Since then nada! Zilch!

 

I sent letter 2 accepting the microfiche and reminding them of the 40days

Again nada Zilch

I kept meaning to chase and chase, but time goes.

 

Anyway - I wrote to them about 3 weeks ago, saying they had 7 days to provide me with the required archived statements.

 

They replied with a standard - sorry if you are not happy blurb. Basically, I still haven't received my archived bank statements.

 

Can someone please hold my hand and help me get them back?

 

I am at my wits end at the moment.

Have you made a complaint to the ICO about the non-compliance and why not do a estimated claim with the information you do have.

 

Dont worry we will get this sorted and dont let them get you down!!:)

Don't look good for abbey regarding non compliance with DPA, my personal opinion is get your money back. So go with an estimated claim with the info you have. Don't look good for them that they have not complied with your DPA request, so in your favour. Going to have to comply now any way so use it to your advantage. Dirty tricks is the name of the game, you gave them the time to provde the info they did not, make a big issue of this in your LBA and any future correspondence with them or the court.
