    • Hello, After seeing all of the posts about BMW on here I really wish I hadn't even considered them! I bought a used car from them over the weekend, one specifically which had a reversing camera and cruise control in the advert. I was foolish at the time of purchase and didn't check to see these functions work on the test drive (totally my fault). Now that the car is home I've checked and checked and neither of these functions are available. I even checked on Parkers and it seems that no Skoda Kamiq '21 models come with any parking cameras at all. When buying the car, I was told all that was needed was 'Four signatures and £500' to secure it. I was never shown any of the documents, and instead the sales rep opened a box on his iPad and asked me to sign. He had been complaining about the length of time some customers take these days all throughout my time with him. (Again) foolishly I signed. In my email inbox I now have four attachments from BMW, one of which is my signature under a letter which basically says that the cars don't need to match the advertisements online, or have any of the features that a sales rep talks about. I realise that I've made mistakes in not doing my due diligence here, but thought I might as well ask the experts here if I have any rights left to claim that the car was miss-advertised, or if I unknowingly signed them away? Thanks in advance

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ford I'm sitting watching Hearts at the moment, only one word to describe it, dire !!!

it seems to be spreading, eg lfc v soton...

thankfully the championship et al, some real football atm

the scottish leagues suffer even more than the english ones regarding the way television money is put into football to create it own alternative universe.

Hearts may be dire but they are one of the few clubs people want to turn up and complain about. Eventually the club owners will strike a deal to end automatic promotion and claim that it is all about ground capacity, grass quality or the toilets that made them pick the favoured ones. That will make the TV men happy as they will have a decent number of paying extras in the background to give it some atmosphere so people watching the telly in the pub get excited about it all and then spend some money betting on the result whist drinking the sponsors beer.

My sport has its own dress code but we cant wear it should we qualify for the olympics because it isnt the same as the official ( paid for by bribes) olympic kit. So what to do, wear "their" clothes and get disqualified or wear the unform in the international rules and get banned. tough one . Thank fully I am actually quite rubbish so wont have to lose too many nights sleep over it.

Ford, here's me looking forward to sitting in my 'new' seat in our 'new' stand in September and they now tell us this...............

 

 

The wettest June/July in years, coupled with the late delivery of seating from the Far East, due to shipping issues, means we will have to invoke our contingency plan and play our first few home fixtures at BT Murrayfield.

 

While this is disappointing, the cooperation of the management and staff at the SRU means we can accommodate all, indeed even more, of our supporters in fine style at the national rugby stadium.

 

Further details will be given over the next few weeks but for now we simply wish to let our supporters know that the following fixtures will be played at BT Murrayfield.

 

Saturday 9th September 2017: Hearts v Aberdeen (3pm)

Saturday 21st October 2017: Hearts v St Johnstone

Saturday 28th October 2017: Hearts v Rangers

 

At the moment, these last 2 fixtures are scheduled at 3pm but this may, of course, change due to TV selection.

 

Please also note that Partick Thistle have kindly agreed to flip our fixture on 23rd September and this game will now be played at Firhill.

Hearts used Murrayfield a few seasons ago when we qualified for some European games, it was terrible far far too big for football games, no atmosphere and your about a mile from the pitch !!!

 

Too far to throw your scarf when they got beat :)

Randall. ok, but not that good. he's 21 and out on loan! he's out for sale. imo. take a look at our current (poorish) defenders (we're still after Van Dijk), and he can't even displace any of them. though he might be ok for the SPL.

have a watch of the womens footy, seen more tackles there in a couple of games than seen in a season of the nancy Prem league.

do you remember the snoods that came in, and players wearing gloves even though its warmer than an ants nads. also wearing socks over their knees!
