    • Hi I was caught shoplifting 4 items £20 worth, I’m petrified the Police will come to my house now please can you help. What can I do I worried about my job. 
    • I heard nothing more from J&P but have now had an email from the bank saying they have instructed IDR to act on their behalf?  so are they just passing it back? Selling it on again? I don’t know if this is a good or bad thing 
    • I posted a couple of years ago about our debt situation and have been trying to pay off our debt as best we can. It is a possibility I maybe made redundant in a few months time, so I am trying to find out everything I can about what happens in today’s world when you can’t pay. I keep finding conflicting advice on various sites so I wanted to post this quote to get thoughts. It claims basically that the dca will likely get enforceable documents these days and therefore it’s likely you will have to pay dca at some point during the 6 year process.    on here I read a lot of comments assuming the exact opposite of this. A lot of the threads on here state the beginning of the process but I never see conclusive stuff about what happened from start to finish to get insight into whether debts post 2015 have been enforced etc. I hear a lot here not to pay dca companies but most my debts are post 2015 debts I am all up to date on our debts but if I lose my job it is likely I’ll end up where I tried to avoid in the first place. Which is destroying our files and dealing with DCA. I’ll post it below so you can see what I mean.   It is likely that any debts incurred after 2007 will end up with all the documentation being provided and being enforceable. Therefore you should use the time while awaiting responses going through your Income & Expenditure and considering any possiblity of making a full and final settlement. It can take a number of months to reach the stage of a hearing date and exchange of witness statements and normally you would be able to settle or come to an arrangement to pay before the court hearing, once documents have been provided, although this isn’t guaranteed.
    • depends who said sols state their client is. IDRWW vis~IDR(worldWide) are a debt collector regulated & registered in the UK & USA    they are not solicitors. they use various 'for hire' - here use our letterhead paper tiger solicitors. its just a case of who's stupid enough to join their folly. IDR law used to be their fav but they lost do much money, they broke ties after almost being struck off and now do Will/Probate disputes only. IDR Legal are their sols wing. moriarty law Judge and priestly Taheel - a foreign DCA that use absolutely any trick in the book to extort money even pretending to be any of the above inc being the bank themselves in phone calls.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I said this before and will say it again,Genuinely ill and disabled people should have nothing to worry about then !

 

I am sorry to say, but 80% of claimants that attend a medical with ATOS (assigned by the Government as Health Professionals, but there is not one doctor or specialist among them) are told they are fit for work (or do not recieve the 15 points required to get ESA).

 

Out of these 80%, over 50% of them are sucessful after an appeal. I am assuming that a lot of the 80% don't even bother appealing because of the hassle.

 

I can see why the Government do this, as at minimum they will get some people off ESA. I just think they go the wrong way about it. I myself attended one of these medicals some time back. Let's just say I was mentally fragile at the time. I did recieve some points, but not enough to claim ESA. However, the only questions I was aked at the ATOS medical was 'can I get myself dressed, can I go to the shops, can I cook myself some food etc etc, along with a lot of other mundane questions. The system is not working (just the same as the CSA), yet they don't change their ways. They just make it much harder for genuine people to claim.

 

ATOS are just like wheel clampers. The more people they say are fit for work, the more money they recieve from the Government. They don't however have to pay that money back if the people appeal and win.

 

GS4 have had none of their prison contracts renewed (indeed they have even lost a few) because of their cock ups. The same should be done to ATOS. If they had the right people doing the medicals, I feel there would be a lot less people complaining about scroungers and wasters.

 

In a nutshell........Genuine ill and disabled people do need to worry.

I supplied letters from my specialists plus my GP and never had any issues, mainly because there is no cure for RA or a damaged back. Please don't take this incorrectly as it is not meant to offend. On the mental health aspect, it could be assumed that at one time or other a person has mental issues, however these mental issues sometimes resolve themselves or it is done with help from the proper organisation specialising in that type of help.

I can understand the government trying to weed out those with mental issues that have recovered, but are still claiming benefits. Unfortunately because of the actions of a few inconsiderate people the rest of us must suffer and endure humiliation at the hands of ATOS. It is my belief that once these people are weeded out the system, it will be better for all of us that have genuine issues.

It's not only those with mental issues, ATOS do their utmost to weed out as many claimants as possible genuine or not, if the DWP had their way no one would be in receipt of ESA, current thinking is that everyone, regardless of illness or disability is capable of some kind of work. In an ideal society with unlimited funding and job opportunities this ideology might work,as things stand today we do not have the jobs or the resources to accommodate those with physical or mental impairments, forcing these people into destitution is not a humane way to treat anyone.

Many people with mental health issues may go months with no problems and they then have serious problems. Would you really employ someone who could go off sick at short notice for months at a time?

 

There is no way of knowing whether someone has recovered. I had mental health issues at 17 / 18 and was fine from then until just before I was 21.

I am sorry surfer but if you believe that then you are going to be sadly disappointed....this govt is out to make life for the sick ill and disabled an absolute nightmare....I gained 0 points with ATOS, appealed, and eventually couldnt stand it any more and went and managed to get myself a job....and at 58 thought i was damned lucky to get one...however, my appeal went ahead without me and just had a letter because the appeal has been adjourned to get reports from my doctors, so it looks like i may get the necessary points that i need, this govt is determined to hound as many people as they can off the sick, and also to cut the dla budget by 20% if you read the new descriptors a lot of us with mobility problems are going to be big big losers

No disrespect to people of that age; but who wants to hire a 58 year old? They won't be working for much longer. Whereas, someone in their 20s will be working for another 40 years.

 

Many disabled people don't meet the criteria for PIP or ESA. But they're still disabled. I am "lucky" that I meet enough descriptors to in theory, receive ESA support group and the higher rates of PIP. Whether I will get them is another matter.

It seems that in this case they were successful in getting someone off the benefits system and into work as despite their disability they are able to work and be self reliant and probably now have self respect and pride.

I had self respect and pride, and believe you me going back to work is not going to do my health any good at all....but it is means must....I am already in trouble with my leg which fills with blood as i am doing a sit down job, answering phone, causing a lot more damage to the already badly damaged leg...it is swollen so badly by the time I get home that i can hardly get my trouser leg off...

would be if i wasnt tied to a phone for 10 hour shifts....working for british gas answering calls and booking appts.....its ok but only get a break every 2 hours and sitting for that time is causing me problems....in fairness the company are very good and have made some adjustments for me but it is still giving my leg problems...can only try and see how long i can last before something gives!!

tbh was absolutely gobsmacked they offered me the job....didnt think at my age i would ever be entering the market again....only downside is I cant understand a bl**dy word the kids on my shift are talking about!!! as to more exercise that is catch22 cant walk more than 50 yards without leg giving in...and sitting around dont do it any good either...have been told by doc that if i have to sit have to keep leg above height of my heart...bloody impossible to use a pc sat in that position!!

well there have been people saying their sick and claiming for years when really they should have been at work, but now they have been caught out and either their other halfs have been sent to work, its about time the government shook the NON sick from the REAL sick, now the real disabled will be left alone, imagine how much the government have saved on the work dodgers,

How many people found fit for work have been told they can't claim JSA due to being too sick? And how many have won at tribunal?

 

The WCA is illogical. It doesn't take into account things like being able to get up, shower, get dressed, etc. How can you work if you can't do things like that?

i,m talking about the people who have never been sick just lie not disabled people!!, scroungers for want of a better word, its been going on for years people have claimed they have a bad leg then been filmed working or climbing over a wall, these are the scroungers and its got worse thats whythis has been done to get rid of the scroungers so the real disabled people can get the help they really need, and as said before on here if people are truly sick and disabled then they have no worry do they
