Good evening.

 

Could anyone tell me which forms should be filled in when contribution based jobseekers allowance ends and income related jobseekers allowance begins?

 

It seems that I have been transferred to IRJA without being informed. I have not filled in any related forms for this benefit but I was receiving contribution based JSA previously. This has lead to a fraud investigation, so I am somewhat concerned.

Perhaps I should rephrase this. Would the Jobcentre use a 15 month old claim form, correctly filled in and stating that I had an income, to process a claim for Income related Jobseekers Allowance?

 

I would find this weird. Especially given that (I don't know if everyone gets these?) 12 months into my claim, I was sent a letter asking for details of my savings.

Thank you san_d. As that never happened, how on earth did they manage to switch me onto income based benefit? Rhetorical question as I know no one will have an answer other than the actual benefits office involved.

You should have received a letter from the Benefit Centre informing you of the reasons why you're no longer on Contrib. based, but most likely it's because your NI contributions have run out.

 

Go to the Jobcentre you can call your Benefit centre for free.

Thanks san_d. that's not quite why I want to know. I have not had any letters and was getting income based JSA, which they automatically changed me to, without me filling in any forms and without letting me know. I didn't know there were two and therefore didn't tell them about my ex contributing to my bills, as that is not a factor on contribution based JSA. Now I am being investigated for fraud. My question is how can they change you to a means tested benefit without doing the means test?

Can't help with a ref for the form for income based Jobseekers but I'm fairly sure you'd remember if you'd completed one cos it'd have been done at a Jobcentre unless you'd a very good reason for a clerical/phone claim.

 

You may be able to get some info about what's happened through a subject access request. Same procedure as for any other subject access request cept that Jobcentreplus don't charge. :-o Written request to your benefit delivery centre or there's a downloadable form on the Work n Pensions website. Theory is a response within forty days (not working days) but currently they're taking up to sixty days. :tsk:

Thanks Margaret. I know the only form I completed was the initial one, no other form regarding income at all. I can't imagine that they could just give me a means tested benefit based on a 15 month old non means tested claim form (I didn't have access to contribution based JSA for 11 months after I completed the initial claim form) which is why I am trying to find out what was necessary. from anyone who has changed from contribution based to income based.

 

I doubt that the DWP will give me the info as they are making the investigation.

Possibly, possibly not, but you've nowt to lose by trying for it.

 

Whatever, if they're trying to do you for a fraudulent claim, sooner or later, they'll need to find and disclose evidence that you've made a fraudulent claim.

If the relevant form is a JSA3 then I have never completed one or been given one to complete. Somehow, I have been given income based JSA without being informed and without completing the application for it. How the heck can I be doing something fraudulent if I have never been involved?
