    • Thanks DX , true I was reading it as my own licence when I can now see it is the VED thanks for the clarification. As for the payments that does make sense and I will give them a call today. I have to watch the date as I have 21 days from the 29th May to respond to plea of guilty or not.
    • This is the latest response from IDR. I know exactly what has happened - I left Qatar in 2006 leaving behind card debt of QAR13,000 (unintentionally, I thought it was paid off). When I visited Qatar for a weekend in 2012, I was blocked from leaving the country - ended up having to go to the Court, met with the bank and negitiated a settlement  - they wanted about QAR90,000 in total and supposedly agreed on QAR40,000 to settle completely. Unfortunately, I only have a pay-in receipt for that and no confirmation the whole debt was settled: I was so focussed on getting the exit ban lifted. Anyway, I left and I have visited Qatar since then with no issue. My concern is that the statute of limitations  will run from 2012, rather than 2006. Should I continue to ignore or explain to IDR that I don't agree there is an exisiting debt? IDR 10062024 redacted.pdf

    • as with some of your threads in the past. you are not reading things carefully and understanding things properly by going off on assumptions. not sure where you are getting your driving licence is being revoked from? nowhere do they use that word. nothing to do with it. vehicle excise licence. (Road Tax), a VEL cannot be revoked only voided. you are also wrong and nowhere does the DVLA state they cancelled the DD.  the court summons clearly states in the DVLA statement: it was your cancelling/reclaim of the DD on 15-02-2024 that caused this, NOTHING to do with the DVLA, they did not revoke the VEL. as they received no payment, on 02.05.2024 the VEL was Voided. it appears you have got the new DD setup wrong to the wrong DVLA account/ref number/VEL number. they have not received the payments to the correct VEL. i would be ringing DVLA and finding out where these payments are on their system and get them attributed to the correct VEL. that should solve the problem.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I currently have 5 PDLs outstanding and due to my current financial situation I simply have no way of paying them back in full.

 

I am livid at myself for getting into this situation in the first place and have vowed never ever to use another PDL when this is all over but right now at this moment in time it's really getting me down and stressing me out.

 

Wonga - £670 Due 31st July £56 a month over 12 months repayment plan

1 Month Loan - £277 Overdue £23 a month over 12 months

QuickQuid £630 Due 24th August

PayDay Express £360 Due 10th August

Minicredit £125 Due 13th August

 

I was wondering if anyone has successfully negotiated long term repayment plans with these companies and would be willing to help me?

 

I've emailed Wonga and 1Month already proposing a 12 month repayment plan but I'm not feeling very optimistic.

 

The most worrying thing for me however is, because I'm a student and am currently living at home with my parents, these companies bombarding my home number with calls and stressing out my Mum.

Hi elmonoartico. Welcome to CAG.

 

Lets try and help you out. First you need to calm down, and dont panic. With a bit of forethought and knowledge you can get your finances back on track. However, you need to remember its going to be a rough road as you have some of the worst PDL's to deal with.

 

First thing to do is write to each PDL and send them the following letter, edited to suit. http://www.consumeractiongroup.co.uk/forum/content.php?493-Harassment-by-telephone-response-letter

 

Then you need to contact your bank, cancel your debit card and any direct debits or CPA's that are on your account that are related to the PDL's. You MUST secure your money ASAP. The PDL's listed are known for randomly debiting your account whenever they like if they think you wont repay.

 

Also consider setting up a parachute account and put all your money in there to secure it. A good bank to do this with is the coop and open it over the phone. However, the new account MUST be with a completely different banking group than your current one and you must never pay any bills from the new account.

 

Next, go to http://www.nationaldebtline.co.uk/england_wales/debt_advice.php#5 section 3. Use the first link on there for your own records, and never give it to a creditor. Use the second link to give a breakdown of your I&E to a creditor. Work out your offer of a repayment plan using those forms, and write, do NOT phone, and advise each PDL of your situation, stating that you are more than willing to repay the debt, you just need more time. Remember, repayments are done on YOUR terms. The PDL's will try and state they cannot accept less than xxx amount. This is wrong and breaches Regulation. Stick to your guns and send them the same repayment proposal.

 

Be warned though, the PDL's you listed are well known for adding on unfair and illegal charges to a debt to hike it up. They do this in hopes you will either back down and pay whatever amount they say, or that should the debt go to a court, they will get judgement by default and you will be liable for the entire amount. Also understand that you will get a LOT of letters threatening anything and everything they can think of. When you get these, you MUST report them to the OFT, who are the regulatory body for loans, and who are conducting a full investigation into PDL's.

 

Try not to worry. Follow the advice given and then report back once you have a reply from them.

Thanks a lot for the lengthy reply, it may sound stupid but I feel so relieved just sharing my problems on this forum and knowing that there are other people in the same position as me.

 

I've already set up the Halifax EasyCash account and from now on that's where my part-time job wages and student loan funds will be deposited in order to protect them from the PDLs.

 

I'm going to phone the bank tomorrow to report my current card 'lost' and I've already cancelled any Direct Debits.

 

From experience I've actually found the bigger companies such as Wonga and QuickQuid fairly easy to deal with and they only ever contact me via email which is good. It's the various other smaller companies such as PDExpress and Minicredit, and PaycheckCredit in the past were horrendous, that are very difficult and insist on calling my home 10 times a day and causing my parents stress when the answer the phone to them.

 

I'm hoping to hear back from Wonga and 1MonthLoan tomorrow so I'll post back with what they say, hopefully positive stuff but I'm prepared for the worst.

Repayments are to be done according to youre financial situation. Not what amount they decide to pluck out of thin air. And then have the cheek to hike the debt up even more if you cant meet their repayment plan.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

1 Month Loan have accepted my offer of repayment plan now also and I'm just awaiting them sending their bank account details for me to set up the standing order.

From my experience with PaydayExpress and MiniCredit i wouldnt hold out much hope of agreeing anything with them, i just tried to clear the payday express loan i had asap and avoid extensions/added interest because it was evident right from the first email i sent that they werent going to agree to any sort of staggered plan. Wonga and Q.Q should both agree fairly easily although quickquid could only offer me a 4 month plan with interest frozen. Good luck anyway, you will feel so much better as you start getting each loan paid off, i'm also living at home with parents and understand how you feel, everytime the phone goes i expect it to be someone chasing me up.
