    • The Barclay Card conditions is complete. There was only 3 pages. This had old address on. Full CCA. 15 pages. The only personal info is my name and address. Current Address The rest just like a generic document.  Barclays CCA 260424.pdf
    • An update to this case as I’ve not been on in a while.    I am still awaiting a charging decision in the case. The two police officers involved have said their personal belief is a section 47 ABH charge is the most likely outcome but this isn’t a sure thing of course.    The EA certificate from the issuing court has now lapsed. The court have refused to recertify him until they’ve had a hearing in to the case, and the district judge has issued orders to surrender all evidence, footage, photos etc.    I have done so promptly.    the EA, not so much . Equita have claimed they cannot provide his bodycam footage as the camera he was wearing is the EA personal one not one of theirs.   the EA has claimed he has asked Equita and the police for the footage as he claims he doesn’t have it.    the police have confirmed they didn’t seize his camera and they don’t have it.    so they are basically pointing the finger at each other all the while failing to comply with the district judges order to provide all evidence they intend to rely on at the rescheduled hearing.    The district judge has stated the hearing for his certification will NOT be the hearing for my complaint as there is no charge as of yet, and just as to whether he should be recertified or not.    I’m not 100% on why that can’t be done at the time, but I’m not about to question a judge…..

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Starting a claim against Santander, was originally sold by to my wife by Evans at the tills, pressure selling, sign here gets loads off, and great deals ect, you know how it goes

 

She didn't know it had PPI on it until i did SAR, there's a small box which has been ticked which say "I wish to purchase Account Cover insurance" her signature is above and below it, the box has of course been ticked, but other than that the only mention of the insurance is a box mention some benefits and nothing about conditions, the terms of the store card are actually tine I don't know if that's just because they have been shrunk when they copied to send me (A4) but I really doubt it.

 

Now I have tooted up all the payments and done the Questionnaire, the thing I need to know now is which spreadsheet should I be using to work out the interest?:|

The problem is when I did the SAR back in January they didn't produce any statements, they mearly produced a "list of transactions" which would make filling in the 3rd spready impossible, we might be able to find a few but I i would have to dig in about 3 hundred boxs in a dark storage container to find them, thats not going to be easy :ohwell:

This third spreadsheet is a calculator that will work out a fos based PPI award on a Revolving Credit Account such as a credit card. It will also work out the additional 8% interest awarded where the account moves into credit as a result of the removal of the PPI from the account. Be aware that you will need ALL of the account statements for this spreadsheet to give the correct result.

Ok got it, I got a little mixed up to start, 209 has suddenly turned into 793 :!:

 

Whats Santander usually like at accepting claims, i know each claim is different and isn't guaranteed to be treat the same as the last, just wondered if there was a norm.

It is difficult to say how they will respond to your claim, so it would be wrong of us to advise otherwise.

 

A properly prepared spreadsheet and clear reason as to why you believe the PPI was mis sold - which you appear to have, should result in a reasonably prompt settlement. Although "prompt" is a word the banks dont seem to fully understand.

 

They have 8 weeks in which to respond to you and in the event that they say no, then you have choices. Challenge their decision, submit your claim to the FOS or issue a claim against them in the County Court.

Somthing I have just been thinking about.

 

My wife has have never received any insurance policies, policy numbers, or other literature, as far as it appears so far there is no evidence that a policy even exists, there is evidence from the transaction list that money has been taken for a policy, therefor I can only come to the conclusion that either Santander have failed to fully comply with a comply with Subject Access Request and have withheld documents regarding the account to which I would have to ask why, the only other possible scenario I can possibly see is that no insurance policy has ever been set up, which raises my eyebrows higher than they have ever been raised before, is there not legal implications there (IF that's the case).

 

Of course I could be completely wrong and they may have a policy but why wouldn't there have been any mention of it in the stuff that came back when I SARed other than 1 entry on the contact list when my wife called them to cancel cover in 2010
