      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes that would have been a handy call to have recorded!Still they did not phone me back in spite of their threats! i got one call later that day which may or may not been Debitas as i did not answer it!Yesterday i did not get any calls at all! so perhaps they did realise that they had gone a bit far in makeing that threat as if that ever came out in any procceedings it wouldnot look very good! I did not get any visitors from Debitas either though i suppose they may try next week!They say i might get a visiter any day of the week including sundays!:rolleyes:I must admit it was a bit of a shock when i saw Beachcomber actually had one call round in connection with Crapital one/Debitas! as i thought they were normally empty threats if they came from crapital one! Though having said that Gazza i know you had one from a Barclay card agent!They were mean though and sent you a man!They just dont treat you right Gazza!They should have sent a nice lady!If Debitas do pay me a visit they probably will not catch me in! as i work fulltime and i hope for their sakes that they do not get my hubby answering door as he knows how to treat unwelcome visiters! and they will get some colourful language!He might even start waving his baseball bat around!:Don a serious note though they will find they have wasted their time and petrol as the door will be locked and if anyone does answer it the door will be shut in their faces!

Yes, I think it was mean on Barclay card to send a man to my door and not a nice blonde :D. Then again if a nice blonde did come she might of broke my will to pay them :D.

Yes very mean of them sending a man but as you say a blonde might have broken your will not to pay them! LOLIve got to go to work in a minute !Imust be mad working on a sunday! LOL:(Have to keep reminding myself the money will come in handy!

Just when you think they've gone away, they pop up again lol.

Had a threatagram today from our one and only Debitas demanding money, as they cant go away on there Christmas hols without my money lol. As Capital one set up a £1 payment plan which i paid at the beginning of the month, how come they've put me back intouch with Debitas.

 

Here's the letter preaty basic template letter they sent out.

Hi Gazza – just wondering if Capone have taken your cca postal order payment of £1 and credited this against your account – this could be why they are so confused right now and think you are on a £1 per month payment plan.

Methinks its time to send that letter asking them to verify if an agreement actually exists – highly unlikely if it was set up on the phone.

I never sent a postal order, i always go to the bank and pay a £1 of my statement they send me every month. That way i know there getting the £1, i know they dont like me doing this that way.

Yes, it looks like there be receiving another letter from me.

Dear Debitas,

 

I am in receipt of your letter dated (whenever).

 

I have a payment plan in place with Capital 1 Bank, please see letter enclosed. If there is a query regarding that, then I would suggest you contact Capital 1 Bank, directly.

 

Please also note, I take issue with your statement " we are concerned that by not responding", I have replied to each letter as it arrives and have proof of doing so.

 

I have requested communication in writing as is my right. This protects me in the event that you do take further action, I will therefore not be contacting you by telephone.

Hi Gazza!

Debitarse has been strangely quiet on my phone since they threatenend last week to phone me very five minutes until i talked about my account on phone to them!Perhaps even they realised that that would be illegal phone harrasement!and thought they had better not phome me so much! However i have been getting some silent calls from tel no 08004220280! and wondered if anyone on this thread recognised it!I cant help thinking it may be Debitarse but could be another DCA but dont want to ring it:eek:As citazen B says it would have been great if i could have got a recording of them threatening to phone me very five minutes! It would have been lovely to have played that recording back to TS or the police!:DYou are mean Gazza not wanting to contribute to their xmas fund!

It is cap one !I saw a link on search engine called phone call reports saying about that number i mentioned!it confirmed it was capital one and went on to say if you being hounded by **** like that to request a copy of your credit card agreement with them! LOL That was this sites actual words! Looks like crap one/Debitarse gettting well known on the web for silent and nuisance calls!:D

Hi Gaz! Dont they give you the silent call treatment!As i said i must have really upset them when i asked for my CCA agreement as straight after sending that bog roll letter in response to my request the next day in post after receiveing that i got the default notice the following day!:eek:and they went on to quickly terminate me!:eek:They diont hang about do they!CCA requests seem to upset them!:grin:

How the heck did you manage to set up a payment plan with crap1.

 

I've been battling this for six months now and they won't budge unless I supply wage slips, bank statements, proof that OH is now unemployed & my tax returns & tax statements.

 

Until I 'comply' ms renshaw has stated twice, in writing, that they have every right to keep ringing until I send the stated documents (which of course I have absolutely no intention of doing).

Don't ask me i'm baffled as everyone else about how Capital 1 works.

The letter is on 23 of this thread, and its only for 6 months till they look at it again. I did pay the first payment at the beginnning of November, just waiting for my statement to come through to see if they have stopped all interest and charges to this account.

Hi Gazza, have you previously sent them a letter to which you havent had a reply.

 

I received one of these last year.. I was puzzled in that I hadnt any outstanding mail. I wonder if it is just a ploy to get a copy of your signature.?

 

If you do have outstanding correspondence with them, just send them a reply to their letter using a fancy script font. I personally use "Miss" which is a free font. I think Microsoft have something like the 2 below you could use. Dont however use your own signature. :D

No, this letter was a bit out the blue.

I'm sure i received a letter before christmas from them stating the same thing. I replyed with a copy letter they send me.

The Fonts look preaty cool, i look them up and try it out.

If you have a font package on your computer, you should already have the two I have shown. However, there are plenty of free font websites just search for " free handwriting fonts"

 

As regards your letter, if you have nothing outstanding.. file and ignore.
