Re moving on to your claim with MBNA, you are right to be reading up on how claims go with them. Each bank handles claims against them differently so good preparation and knowing your enemy will serve you well.

You've really helped me through all this, it is truly appreciated.

 

I now have to send a notice of discontinuance to the court which I believe is form N279. Sorry for the silly question, but I'm assuming the court fills in the part about the Judge as it didn't get as far as a hearing date? And that I send it to the Salford address?

 

Your advice, as always is appreciated.

Hmmm, I didn't know there was a specific form for this (N279 ?).

 

I have always told folk to simply send a letter to the court manager quoting the Claim No. saying :-

 

Dear sir or madam,

 

Claim No: 1AB54321

 

I refer to my claim against Barclays Bank PLC.

 

I am pleased to confirm the matter has been settled by agreement between myself and the Defendant.

 

I am grateful to the court for it's service and now wish to discontinue my claim.

 

Yours faithfully,

 

Do not do this, however, until you have resolved all issues with the bank.

Hi Up2,

 

During any dealings I have had with BC they have always sent the relevant documentation for me to sign when business is complete, and like Slick has advised, never sign anything until you are completely satisfied with your result of business.

Thanks for looking in guys (been swimming or rather drowning in various other threads)

 

I was going to send a letter until the paralegal at Barclays mentioned the words Notice of Discontinuance so Googled it and came up with the MoJ form!!

 

I would prefer just to send the letter, which I will do. I'm just waiting for 1st Crud to update credit report, other than that every thing else is sorted (apart from the cheque clearing because it's not going in til tomorrow - I'm sure it will clear okay - although this is barclaysharks we're talking about :lol:)

 

Do I send it to the Salford address?

I would be grateful for any MBNA advice anyone has to offer - I have a thread Here.

 

Just filed the brief description on MCOL which was issued today. Working on the detailed POC now.

 

Particulary interested in how anyone worded / handled this bit

 

Interest under section 69 of the County

Courts Act 1984 at the rate of 29.9% per

annum on the amount claimed (daily rate of

£2.57) until judgement or sooner payment.

 

As I have just been informed it should read 8% :(
