    • There is no evidence that I was issued a PCN that was placed on the car and removed. It seems that I was issued a £60 PCN on the 8th of March (the parking date) but it was never placed on my car, instead,  they allege that they posted the PCN on the 13th of March and deemed delivered on the 15th. I never got this 1st £60 PCN demand. I only know about all of this through the SAR. I only received the second PCN demanding £100, which was deemed delivered on 16/04/2024 - that is 39 days after the parking incident.  I did a little research and "Legislation states that postal PCNs must be sent within 28 days, unless otherwise stated in the Regulations." as per London Councils Code of Practice on Civil Parking Enforcement.  The main issue is that I was not aware of the 1st £60 PCN as I didn't receive it - I'm not sure how this relates to the 28-day rule because that rule applies to the initial £60 PCN. PCM could say that "we sent him the letter by post and it was deemed delivered on the 15th of March" therefore the 28-day rule does not apply.  As regards the safety of the parking attendant, that is clearly something he chose to feel and he made the decision that his safety was threatened - I didn't even see him or had any interaction with him. I'm nearly 50 and I definitely don't look aggressive 😊

    • Personally I would strongly suggest not risking going there with debts. Very possible you wont get back out again. And I know many in that position. Not jailed just unable to leave. the stories of Interpol in other countries sounds far fetched but in and out of Dubai is not a good idea. only two weeks ago a mate got stopped albeit a govt debt.
    • BTW the time in and out is less than 10 mins, more than 5 in case that's relevant? I saw an article posted on here about a year ago a proposed legislation change but i don't know if that went through or not? I'm also a blue badge holder but there it was a regular parking spot.   Private parking fines to be capped at £50 WWW.BBC.CO.UK Drivers will also need to be given a grace period for lateness, as part of a crackdown on parking firms.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just asking on behalf of a friend of my daughters

 

She is currently doing an NVQ Level 2 course and will obviously want to continue to do the Level 3.

 

In late August she will be having an operation which basically involves having her jaw broken and has a four week recovery period.

 

She was talking to tutor about this and was told she would not be allowed to enrol for the Level 3 course because she would miss too much work. She is 18 so if she has to wait till the following year she will have to pay for the course. The course starts around 5th September.

 

Is this correct that she can't enrol as usually nothing much is done in first week and she is prepared to work to catch up. The four weeks is only a guideline recovery period it could be shorter, depends on the individual.

 

Seems a bit wrong to me but just wanted to see if they were allowed to stop her enrolement.

I have to agree with assisted blonde on this ENROL BEFORE THE OP, then go sick. If you can have a look at there website where they ar going to enrol as they should have a students handbook which should give info on time off for medical reasons.

Trouble is she has already told them she has to have op in August that is why they won't accept her enrolment.

 

Will have a look at the student handbook though see if that says anything

If she didnt put in writing she could say that the op has been postponed and she is waiting for a new date, or that she has postponed until she has completed her course. Just a question though if her op isnt until late August then its not an emergency so could she manage to carry on without having it for now and actually ask for a new date or could she say to the hospital that she would take a late cancellation if it becomes available?

Not sure I think it is an op she has been waiting for a while that they would only do when she is 18 and they are doing it as soon after her 18th birthday as they had a slot for. She has some sort of problem with her jaw she has had all her life and they waited till she older to do the op.

 

She hasn't put it into writing she just mentioned it to her tutor in passing

 

Couldn't find anything in the student handbook about absence due to illness

well mention to the tutor in passing that op has been postponed really cant see that they can stop her enroling if there are places on the course, colleges are under pressure to fill courses so unless its really oversubscribed I cant see their problem

Ok I'll tell her to do that then or just not mention it again as tutor might forget anyway, it was only a passing comment she made when they were talking about how many wanted to carry on to level 3.

 

They did say the places were going to be limited a while back though as a lot of them have low attendance and tutor said if they had below 90% they wouldn't be guaranteed a place.

Dont mention it again unless tutor remembers and just sign up worry about time off afterwards, its not really the tutors problem if she has to go sick, its not a job its a course so it wont be costong him/her anything and if she had an accident or similar they would be only too happy to help with extra tuition/honme work etc to enable her to catch up. At the moment 16-18 year olds are like gold dust to colleges due to the amount of money they bring in, so I think that it is highly unlikely they won't let her enrol. I know from experience that students are reguarly re enrolled when they've said that they're not coming back or have other plans, just to keep numbers up! Also student are enrolled even if they won't come in for a number of weeks for reasons such as illness, holidays etc. What may happen is that all the students will be re-enrolled automatically near the end of course with the assumption they will come back in September. She really needs to get hold of the colleges terms & conditions that she should've received when she enrolled & have read through to see what they say regarding absence. If they are already enrolling for next year grab a copy of that. Try and get a paper enrolment form if she can as that should have everything on it. In the meantime tell her not to panic as it's early days & things will probably change nearer September when numbers are down. She should also look around to see if she could study the course elsewhere a sixth form or another college for example .A place elsewhere can cause wonders come September!!

Seems like a sticky situation. The best way is probably what has been echoed on this forum of enrolling then going on the sick if you can, or trying to come to some kind of agreement whereby she could do some work during her recovery. Seems quite harsh that they would just refuse her enrolment when she has to have this operation.

I have passed all the suggestions on to her. She doesn't want to alter the date for the operation as she has been waiting to be able to have the op for years and is glad it has finally come round. I fail to see she would miss anything significant in the first couple of weeks.

 

They put that much "extra" stuff on courses to pad them out they only actually started doing nails when they went back on the course after Xmas break, first 3 and a bit months were other bits and pieces. Think this is because they haven't actually got the station space for the amount of students at the start so can't go straight into it. Couple of months in they have lost a few so then can cope/

 

Unfortunately where we are there is only one campus that has the facilities to do the nail course so it is space restricted and there were more bums than seats at the start of this course, they seem to rely on a certain amount dropping out or being thrown off to level it out, so they say as there are limited places that you have to have at least a certain level of attendance the previous year to get a place on the next level.

 

Think they are using her op as an excuse not to get over subscribed again next year and fob her off. Luckily nothing put in writing and was only a casual comment on her side so if she goes to enrol in early August then she might be accepted as the convo might have been forgotten by then.

Sounds like a case of numbers/money rather than anything else. Remember colleges also get paid for achievement so this is probably the reason that other things were studied beforehand. Sorts the wheat from the chaff if you see what I mean. Lack of space is probably the last reason....

 

As I said before tell her to re-enrol preferably as soon as she can & don't worry about being accepted. Remember she is gold-dust to the college, they deffo won't want to lose her!!
